64-814WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 64-65-22 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones mentioned and described in said proceedings, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as therein set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 4th day of November, 1964, as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of the property therein described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones as recommended by the City Planning Commission; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hear- ing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth, said property being Parcel 2 only of Reclassification No. 64-65-22. NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: RESOLUTION NO, 64R-814 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. 64-65-22 That portion of the Southeast quarter of Section 6, Township 4 South, Range 10 West, in the Rancho San Juan Cajon De Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the intersection of a line parallel with and distant 50 feet Northerly, measured at right angles, from the South line of said Section 6, with a line parallel with and 50 feet Westerly, measured at right angles, from the East line of said Section 6; thence North 0 47' 15" West along the last mentioned parallel line a distance of 150.00 feet to the true point of beginning; thence North 0 47' 15" West 40.00 feet; thence North 89 21' 40" East 20.00 feet to an intersection with a line parallel with and 30.00 feet Westerly, measured at right angles from the East line of the Southeast quarter of said Section 6; thence North 0 47' 15" West along the last mentioned parallel line a distance of 374 feet, more or less, to an intersection with the Easterly prolongation of the Southerly line of Lot 130 of Tract Number 2201, as shown on a Map recorded in Book 63, pages 47 through 50 of Miscellaneous Maps, records of Orange County, California; thence South 89 21' 40" West along said prolongation and South lines of Lots 130 through Lots 150 to the Northeast corner of Lot 157, all of said Tract Number 2201; thence South 0 46' 40" East 292.11 feet along a portion of the boundary line of said Tract No. 2201, to the Northeasterly line of the land described in the deed to the State of California recorded June 9, 1950 in Book 2025, page 38 of Official Records of Orange County, California; thence South 57 13' 30" East 355.06 feet along said Northeasterly line to the most Westerly corner of land described in Parcel One in the deed to the State of California by deed recorded June 23, 1955 in Book 3113, page 345 of Official Records of Orange County, California; thence South 84 14' 12" East 119.85 feet thence North 89 21' 40" East 457.01 feet to an angle point in the Northerly line of the land conveyed to the State of California by deed recorded July 20, 1955 in Book 3144, page 583 of Official Records of Orange County, California; thence South 80 27' 33" East 253.89 feet; thence North 0 47' 15" West 121.87 feet; thence North 89 21' 40" East 125.00 feet; thence North 0 47' 15" West 10.00 feet; thence North 89 21' 40" East 25.00 feet to the true point of beginning. be excluded from C -2, GENERAL COMMERCIAL, C -1, NEIGHBORHOOD COMMERCIAL, and R -A, RESIDENTIAL AGRICULTURAL, ZONES and incorporated in C -0, COMMERCIAL OFFICE ZONE, upon the follow- ing conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 60 feet in width, from the center line of the street, along Brookhurst Street, for street widening purposes. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along La Palma Avenue, for street widening purposes. -2- ATTEST: 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Brookhurst Street, for street lighting purposes. 4. That the owners of subject property shall pay to the City of Anaheim the sum of 15Q per front foot along Brookhurst Street, for tree planting purposes. 5. That the owners of subject property shall dedicate to the City of Anaheim all vehicular access rights to Rhodes Avenue. 6. That trash storage areas shall be provided in ac- cordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. 8. That a modified cul -de -sac shall be provided at the terminus of Rhodes Avenue; that said cul -de -sac shall be subject to the approval of the City Engineer, and shall be constructed prior to final building in- spection. 9. That Conditions Nos. 1, 2, 3, 4 and 5 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
