64-811RESOLUTION NO, 64R -811 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 64 -65 -14 to consider n amendment to Title 18 61" FEE 2672Wii nt Code rel ting to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence ,;:nd reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro posed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 4th day of November 1964 as the time, and the City Council Cha er° e a T City Hail of the City of Anaheim as the place for public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situ- ted and the incorporation thereof in the zone or zones hereinaft r set forth, and did give notice there- of in the manner and fore as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed foesaid public he ring the City Council did hold and conduct such public hearing nd did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated nd incorporated in the zone or zones as hereinafter set forth; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, .mended nd that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit -1- 64 -65 -14 Parcel 1: The North 40 feet of Lot 42 of the Hart Subdivision as shown in map recorded in Book 7, Page 20 of Miscellaneous Maps, Records of Orange County, California. Parcel 2: The South 120 feet of the East 135.32 feet of Lot"A,"Tract No. 97, as shown on a map recorded in Book 11, page 39 of Miscellaneous Maps, Records of Orange County, California. Parcel 3: The North 40 feet of the South 200 feet of the East 135.32 feet of Lot "A of Tract No. 97, Sinclair Ranch, as per map thereof recorded in Book 11, page 39 of Miscellaneous Maps, Records of said Orange County. Parcel 4: The North 40 feet of the South 240 feet of the East 135.32 feet of Lot "A," Tract 97, Sinclair Ranch, recorded in Book 11, Page 39 of Miscellaneous Maps, Records of Orange County, California, being more particularly described as Lot 36 of Hart Subdivision, as per map thereof recorded in Book 7, Page 20 of Miscellaneous Maps, Records of said Orange County. Excepting therefrom the Easterly 5 feet thereof. Parcel 5: The East 135.32 feet of Lot "A" of Tract No. 97, Sinclair Ranch, as per map thereof recorded in Book 11, page 39 of Miscellaneous Maps, Records of Orange County, California. Except the North 145 feet thereof, and the South 240 feet thereof. Parcel 6: Being that portion of Lot 'A," Sinclair Ranch, Tract 97, as per map thereof recorded in Book 11, page 39 of Miscellaneous Maps, Records of Orange County, California, beginning at a point 100 feet South of the South limits of Romneya Drive and 75 feet West of the West limits of North Lemon Street; thence continuing West 60.32 feet parallel with the South limits of Romneya Drive; thence South 45 feet parallel with the West limit of North Lemon Street; thence East 60.32 feet parallel with the South limits of Romneya Drive; thence North 45 feet parallel with the West limit of North Lemon Street to the point of beginning. Parcel 7: That portion of Lot "A" of Tract No. 97, Sinclair Ranch, as shown on a map recorded in Book 11, page 39 of Miscellaneous Maps, Records of Orange County, California, described as follows: Beginning at a point on the West limit of North Lemon Street 100 feet South from the Northeast corner of said Tract No. 97; thence continuing South 45 feet along the said West limit of North Lemon Street; thence West 75 feet parallel with the North limit of said tract; thence North 45 feet parallel with the West limit of North Lemon Street; thence East -2- 75 feet to the point of beginning on North Lemon Street; also more particularly described as that portion of the Hart Subdivision as shown on a map recorded in Book 7, page 20 of Miscellaneous Maps, Records of said Orange County, and being the Easterly 75 feet of the North Alley, together with the Northerly part of Lot 28, for a width of 30 feet and a depth of 75 feet of the Easterly part of said Lot 28. Parcel 8: That portion of Lot "A" of Tract No. 97, Sinclair Ranch, as per map thereof recorded in Book 11, page 39 of Miscellaneous Maps, records of Orange County, California, described as follows: Commencing at the Northeast corner of said Tract No. 97; thence West along the North line of said tract, 41.51 feet to a point; thence South parallel to the West line of said tract, 100 feet to a point; thence East parallel to the North line of said tract, 41.52 feet to a point on the East line of said Tract No. 97, said point being 100 feet South of the Northeast corner of said tract; thence North along the East line of said tract, 100 feet to the point of beginning. Parcel 9: That portion of Lot "A" of Tract No. 97, Sinclair Ranch, as per map thereof recorded in Book 11, page 39 of Miscellaneous Maps, Records of Orange County, California, described as follows: Commencing at the Northeast corner of said Tract No. 97; thence West along the North line of said tract,83.02 feet to the true point of beginning; thence South 100 feet parallel to the West line of said Tract No. 97; thence East 41.52 feet parallel with the North line of said Tract No. 97; thence North 100 feet parallel with the West line of said Tract No. 97 to a point in the North line of said Tract No. 97; thence along the North line of said Tract No. 97, 41.51 feet West to the true point of beginning. Parcel 10: That portion of Lot "A" of Sinclair Ranch, Tract No. 97, as shown on a map recorded in Book 11, page 39 of Miscellaneous Maps, Records of Orange County, California, described as follows: Commencing at the Northwest corner of said Tract No. 97; thence East along the North line of said Tract 166.04 feet to the true point of beginning; thence South 100 feet parallel with the West line of said Tract No. 97; thence East 41.51 feet parallel with the North line of said Tract No. 97; thence North 100 feet parallel with the West line of said Tract No. 97 to a point in the North line of said Tract No. 97; thence along the North line of said Tract No. 97, 41.51 feet West to the true point of beginning. -3- be excluded from R -3, MULTIPLE FAMILY RESIDENTIAL ZONE and P -1, AUTOMOBILE PARKING ZONE, and incorporated in C -2, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Lemon Street, for street widening purposes. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Romneya Drive, for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim along Romneya Drive, including prepara- tion of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 4. That sidewalks shall be installed along Lemon Street as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, and said sidewalks shall be installed prior to final building inspection. 5. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lemon Street and Romneya Drive, for street lighting purposes. 6. That the owners of subject property shall pay to the City of Anaheim the sum of 15c per front foot along Lemon Street and Romneya Drive, for tree planting purposes. 7. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 8. That ConditionsNos. 1, 2, 3(b), 5 and 6 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. -4- THE FOREGOING RESOLUTION is approved and signed by me this 4th day of November B ATTEST Dene M.
