64-806A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT T BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED, RESOLUTION NO 64R -806 WHEREAS, the City Planning Commission of the City of Anaheim did hold a public he ring in Reclassification Proceed- ings No. 64 -65 -28 to consider an amendment to Title 18 o t' e 2 tea` elm aura cpa Code re1,= Ling to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said he ring did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that certain zone or zones be changed as hereinfter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 20th day of October 19 64 ,:'s the time, and the City Council Ch: ers In t e CityRl of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed fo? said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit -1- 64 -65 -28 All that certain land situated in the State of California, County of Orange, Rancho San Juan Cajon de Santa Ana, described as follows: That portion of Block G of the Kraemer Tract, as shown on a map recorded in Book 12, Pages 87 and 88 of Mis- cellaneous Records of Los Angeles County, California, described as follows: Beginning at a point on the Southerly boundary of said Lot G, said point being the intersection of Orangethorpe Avenue and Dowling Avenue; thence North 73 32' 00" East 242 feet, more or less, to a line perpendicular to the South line of said Lot G and 203 feet distant from the proposed realignment of Dowling Avenue; thence North 16 28' 00" West 203.00 feet; thence parallel with the South line of said Lot G, South 73 32' 00" West 209 feet, more or less, to the center line of Dowling Street; thence, along said center line, South 7 East 207 feet to the point of beginning. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in C-1, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That the final map of Tract No. 5389 shall be submitted to and approved by the City Council, and recorded in the Office of the Orange County Recorder, or (a) That the owners of subject property shall deed to the City of Anaheim the required right of way dedication for Dowling and Orangethorpe Avenues in conformance with plans on file in the Office of the City Engineer. (b) 1. That all engineering requirements of the City of Anaheim along Dowling and Orangethorpe Avenues, including preparation of improve- ment plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer; and 2. That a bond in an amount and form satis- factory to the City of Anaheim shall be posted with the City to guarantee the in- stallation of said engineering requirements. (c) That the owners of subject property shall pay to the City of Anaheim the sum of 2.00 per front foot, along Dowling and Orangethorpe Avenues, for street lighting purposes. (d) That the owners of subject property shall pay to the City of Anaheim the sum of 15c per front foot along Dowling and Orangethorpe Avenues, for tree planting purposes. -2-
