64-781RESOLUTION NO. 64R -781 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 613 WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from John F. and Mary R. Kirsch and Richard C. and Patricia Ann Kampling,2240 E. South Street, Anaheim, California, to establish a one and two -story multiple family, planned residential develop- ment, with associated recreational facilities, and permitting a waiver of the minimum front, side and rear yard requirements, the minimum lot size and the minimum distance between main and accessory buildings requirements, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel 1: The East half of the Northwest quarter of the Northwest quarter of Section 13, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscel- laneous Maps, records of Orange County, California. Excepting therefrom the West 330 feet of the North 650 feet thereof. Also Excepting therefrom the East 255 feet of the North 160 feet of the West 585 feet thereof. Parcel 2: The East 130 feet of the West 585 feet of the North 160 feet of the East one -half of the Northwest one quarter of the Northwest one quarter of Section 13, Township 4, Range 10 in the Rancho San Juan Cajon de Santa Ana, as shown on a map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on September 28 ,19 64 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 1365 Series 1964 -65 denying Conditional Use Permit No. 613 and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit and did thereupon fix the 27th day of October 19 b4 as the time and the Council Chamber in the City Hall -1- of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 613 should be denied. CLERIOF THE CITY OF ANAHEIM NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying Conditional Use Permit No. 613 be, and the same is hereby sustained and that the request of John F. and Mary R. Kirsch and Richard C. and Patricia Ann Kampling for a Conditional Use Permit to establish a one and two -story multiple family planned residential, development, with associated recreational facilities, and permitting a waiver of the minimum front, side and rear yard requirements, a waiver of the minimum lot size require- ment and a waiver of the minimum distance between main and acces- sory buildings requirement, on the property hereinbefore described, be, and the same is hereby denied without prejudice.
