64-765RESOLUTION NO. 64R -765 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO, 605 WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from WILLIAM G. McMANUS, 101 Ocean Avenue, Apt. K -4, Santa Monica, California, to establish a walk -up restaurant, and permitting a waiver of the minimum parking space requirement, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The South 70 feet of the North 375 feet of Lot No. 5 in Block "B" of Tract No. 13, as recorded in Book 9, Page 12 of Miscellaneous Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on August 31, 1964 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 1311 Series 1964 -65 rantin Conditional Use Permit No. 605. subiect to the conditions set forth in said resolution and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said Condition 1 Use Permit and said appeal was set for public hearing on -1- ATTEST: DENE M. WI CITY CLERK OF AMS, City Clerk s.„,,a 4.2 di; Deputy THE CITY OF ANAHEIM October 20 19 64 at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hear in, that Conditional Use Permit No. 605 should be denied. without prejudice. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting Conditional Use Permit No. 605 be, and the same is hereby disapproved and that the request of WILLIAM G. McMANUS for a Conditional Use Permit to establish a walk -up restaurant, and permitting a waiver of the minimum park- ing space requirement, on the property hereinbefore described, be, and the same is hereby denied, without prejudice.
