1965-150RESOLUTION NO. 65R -150 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 659 WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from GRACE ELIZABETH DICKERSON, c/o MacMahon, Nelson Tilson, 1695 West Crescent Avenue, Anaheim, California, to establish a 64 -unit one and two -story multiple family residential develop- ment, with subterranean parking, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The West 7 acres of the North 20 acres of Lot 10 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof made by William Hamel and filed in the office of the County Recorder of Los Angeles County, California; EXCEPTING THEREFROM all that portion of said land lying 40 feet Northerly of the center line of East Broadway, as shown on a map of Tract No. 1565, recorded in Book 49, pages 19 through 24, inclusive, and Tract No. 1770, recorded in Book 59, pages 7 through 10, inclusive, Miscellaneous Maps, records of said Orange County, as granted to the City of Anaheim, a municipal corporation, in deed recorded October 13, 1954, in Book 2841, page 188, Official Records, in the Office of the County Recorder of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on December 7 ,19 64 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 1450 Series 1964 -65 denying Conditional Use Permit No. 659 and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit and did thereupon fix the 11th day of January 19 65 as the time and the Council Chamber in the City Hall -1- of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 659 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying Conditional Use Permit No. 659 be, and the same is hereby sustained and that the request of GRACE ELIZABETH DICKERSON for a Conditional Use Permit to establish a 64 -unit, one and two -story multiple family residential develop- ment, with subterranean parking, on the property hereinbefore described, be, and the same is hereby denied.
