1965-143RESOLUTION NO. 65R -143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 653. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from Agajanian Investment Corp., 13571 Harbor Blvd., Anaheim, Cali- fornia, to establish a one and two story, multiple family planned residential development, with carports, and permitting a waiver of the following Anaheim Municipal Code requirements: 1. Single -story height limitation within 150 feet of R -A and R -1 zoned properties; 2. Minimum parking; 3. Minimum front yard setback; 4. Minimum distance between buildings, on the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1: That portion of the East half of the East half of the South- east quarter of Section 27, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southeast corner of Tract No. 1965, as shown on a Map recorded in Book 105, pages 27 and 28 of Miscellaneous Maps, records of Orange County, California; thence North 89 38' 00" West along the South line of said Tract No. 1965, a distance of 660.26 feet to a point in the West line of the East half of the Northeast quarter of said Southeast quarter; thence South 0 41' 47" East along said West line and its Southerly prolongation 279.84 feet to a point in the North line of Lot 69 of Tract No. 2520, as shown on a Map recorded in Book 88, pages 11 through 15 inclusive of Miscellaneous Maps, records of Orange County, California; thence South 89 38' 14" East along the North line of said. Lot 69 and along its Easterly prolongation 660.24 feet to a point in the East line of said Southeast quarter; thence North 0 41' 27" West along said East line 279.79 feet to the point of beginning. Excepting therefrom that portion thereof described as follows: Commencing at a point on the East line of said Southeast quarter, said point being North 0 41' 27" West 172.60 feet from the Southeast corner of the Northeast quarter of said Southeast quarter; thence South 86 02' 38" West 48.00 feet to the true point of beginning; thence South 3 57' 22" East 26.50 feet; thence South 86 02' 38" West 41.50 feet. thence North 3 57' 22" West 26.50 feet; thence North 86 02 38 East 41.50 feet to the true point of beginning. -1- PARCEL 2: That portion of the East half of the Northeast quarter of the Southeast quarter of Section 27, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscel- laneous Maps, records of Orange County, California, described as follows: Commencing at a point on the East line of said Southeast quarter, said point being North 0 41' 27" West 172.60 feet from the Southeast corner of the Northeast quarter of said Southeast quarter; thence South 86 02' 38" West 48.00 feet to the true point of beginning; thence South 3 57' 22" East 26.50 feet; thence South 86 02' 38" West 41.50 feet. thence North 3 57' 22" West 26.50 feet; thence North 86 02' 38" East 41.50 feet to the true point of beginning. AND WHEREAS, the public hearing at the City said request on January 18 hearing were duly given as of Title 18, Chapter 18.76 City Planning Commission did hold a Hall in the City of Anaheim upon 1965, notices of which said public required by law and the provisions of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 1502 Series 1964 -65, denying Conditional Use Permit No. 653; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit and did thereupon fix the 23rd day of February, 1965, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 653 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying Conditional Use Permit No. 653 be, and the same is hereby sustained, and that the request of AGAJANIAN INVESTMENT CORP. for a Conditional Use Permit to establish a one and two story, multiple- family planned residential development, with carports, and permitting a waiver of the following Anaheim Municipal Code requirements: Single -story height limitation within 150 feet of R -A and R -1 zoned properties; minimum parking; -2- minimum front yard setback; and minimum distance between buildings, on the property hereinbefore described, be and the same is hereby denied.
