1965-137A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING AND APPROVING THE
EXECUTION OF AN AGREEMENT WITH SOUTHERN PACI-
FIC COMPANY GRANTING TO THE CITY THE RIGHT TO
CONSTRUCT AND OPERATE A 30 -INCH REINFORCED
CONCRETE CULVERT PIPE FOR CONVEYING STORM
DRAINAGE WATERS BENEATH THE PROPERTY AND
TRACKS OF SOUTHERN PACIFIC COMPANY AT ENGI-
NEER STATION 1269 93.6.
WHEREAS, the Southern Pacific Company, a corporation
of the State of Delaware, has tendered to the City of Anaheim
an Indenture granting to the City of Anaheim, subject to the
terms, covenants and conditions therein contained, the right
to construct, reconstruct, maintain, and operate a 30 -inch
diameter reinforced concrete culvert pipe for the conveying
of storm drainage waters beneath the tracks and property of
the Southern Pacific Company at said company's station of
South Anaheim, in the County of Orange, State of California,
crossing beneath the center line of the Southern Pacific
Company s tracks at Engineer Station 1269 93.6, in the
approximate location shown in red on the print of said com-
pany's Los Angeles Division Drawing A -6383, Sheet No. 1,
revised December 21, 1964, attached to and made a part of the
Indenture above mentioned; said concrete culvert pipe shall
conform to all specifications indicated on the print of
Drawing C.S. 1741 of the Southern Pacific Company; and
WHEREAS, said grantor has tendered to the City of
Anaheim the Indenture above mentioned to be executed by said
Southern Pacific Company and the City of Anaheim, which In-
denture the City Council finds would be for the benefit and
best interest of the City of Anaheim and should be approved;
NOW, THEREFORE BE IT RESOLVED by the City Council
of the City of Anaheim that the Indenture tendered to the City
of Anaheim by the Southern Pacific Company, a corporation of
the State of Delaware, granting to the City, but subject to the
terms, covenants, and conditions therein contained, the right
to construct, reconstruct, maintain and operate a 30 -inch
diameter reinforced concrete culvert pipe for the conveying of
storm drainage waters beneath the tracks and property of
Southern Pacific Company at said Company's station of South
Anaheim in the County of Orange, State of California, cros-
sing beneath the center line of Southern Pacific Company's
tracks at its Engineer Station 1269 93.6, as hereinabove
more particularly described, be, and the same is hereby,
approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said
Indenture, above mentioned, for and on behalf of the City of
Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 23rdday of February, 1965.
