1965-100RESOLUTION NO. 65R -100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE EXECUTION OF A SETTLEMENT AGREEMENT DATED FEBRUARY 11, 1965 TOGETHER WITH THE EXECUTION OF A SUPPLEMENTAL SETTLEMENT AGREEMENT DATED FEBRUARY 13, 1965; AND AUTHORIZING THE CITY ATTORNEY AND ASSIST- ANT CITY ATTORNEY TO EXECUTE THE AGREEMENT FOR AND ON BEHALF OF THE CITY OF ANAHEIM; AND IF NECESSARY, AUTHORIZING THE MAYOR PRO TEM AND CITY CLERK TO EXECUTE SAID AGREEMENT FOR AND ON BEHALF OF THE CITY OF ANAHEIM. WHEREAS, negotiations for the acquisition of real property for the Convention Center located on the South side of Katella Avenue and the West side of Harbor Boulevard have been carried on with the owners of fee title and with those who claim through certain leasehold interests; and WHEREAS, in connection therewith there as been sub- mitted to the City Council a Settlement Agreement dated February 11, 1965 and a Supplemental Settlement Agreement dated February 13, 1965 setting forth the basis upon which the eminent domain litigation and all peripheral matters may be amicably settled without further litigation or delay; and WHEREAS, the City Council has reviewed said Settlement Agreement and said Supplemental Settlement Agreement and finds that the terms and conditions set forth therein are fair and reasonable and that it would be in the best interests of the City of Anaheim to settle the eminent domain litigation and all peripheral matters in accordance therewith; and WHEREAS, the City Council desires to authorize and direct the execution of said agreements and to authorize and direct its Finance Director to make certain payments as set forth in said agreements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it authorize and direct and it does hereby authorize and direct the City Attorney and the Assistant City Attorney to execute the Settlement Agreement dated February 11, 1965 and the Supplemental Settlement Agreement dated February 13, 1965 for and on behalf of the City of Anaheim. BE IT FURTHER RESOLVED that the Finance Director be and he is hereby authorized and directed to issue and deliver checks to the City Attorney's Office to carry out the terms of said agreements in the following amounts to the following payees, to wit: Check Payable to: Amount A. Boller, Trustee 760,000.00 Raymond Associates 35,000.00 AND BE IT FURTHER RESOLVED that the City Attorney be and he is hereby authorized and directed to use his office as an escrow to accomplish the acceptance and delivery of funds, the recording of deeds and all other necessary steps to carry out the terms, purpose and intent of said agreements to which reference has been heretofore made THE FOREGOING RESOLUTION is approved and signed by me this 13th day of February, 1965.
