A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE EXECUTION
OF AN AGREEMENT WITH R. A. WATT CONSTRUCTION
CO. FOR THE PURCHASE OF AN EIGHT -INCH SEWER
LINE.
WHEREAS, R. A. Watt Construction Co. has developed
property bounded on the north by the Riverside Freeway, on
the east by the Orange County Flood Control Channel, on the
west by the right of way of the Atchison, Topeka and Santa Fe
Railway and on the south by property presently owned by Eunice
Williams; and
WHEREAS, said construction company has constructed an
eight -inch vitrified clay pipe sewer from the above described
property to a sewer line owned by the City of Anaheim in Com-
mercial Street; and
WHEREAS, in order to develop that property south of
the property of R. A. Watt Construction Co., sewer lines must
be provided; and
WHEREAS, the Riverside Freeway, the flood control
channel and the retarding basin located respectively on the
north, east, and south sides of the property to be developed,
make it extremely difficult to provide sewers; and
WHEREAS, it is anticipated that when the property
south of the R. A. Watt Construction Co. property is developed,
the developers will pay a proportionate share of the cost of
purchasing the sewer line from R. A. Watt Construction Co.;
and
WHEREAS, the City finds and determines that the sewer
line constructed by said construction company should be made
available for future development of the land south of that land
developed by said construction company; and
WHEREAS, the City desires to purchase said eight -inch
sewer line and R. A. Watt Construction Co. is willing to sell
the same; and
WHEREAS, the City and said construction company desire
to enter into an agreement for the purchase and sale of said
sewer line.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that an agreement be made and entered
into with R. A. Watt Construction Co. for the purchase of said
eight -inch sewer line upon the following terms and conditions:
1. The City shall agree to buy and R. A. Watt Construc-
tion Co. shall agree to sell an eight -inch vitrified
clay pipe sewer line to the City. Said sewer line
is more particularly shown and described on Exhibit
No. 1 attached hereto and made a part hereof.

2. City shall agree to pay said construction company
$1,948.21 for said sewer.
3. R. A. Watt Construction Co. shall assign and trans-
fer to the City all rights, whether by way of easement,
license or franchise, it possesses relating to the
installation and maintenance of said sewer line where
said sewer line is located in the right of way of
The Atchison, Topeka and Santa Fe Railway Company
and the Union Pacific Railroad. Said construction
company shall further agree to obtain the consent,
in writing, of said railroads to the assignment of
rights hereinbefore mentioned.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute an agreement for
and on behalf of the City with said R. A. Watt Construction
Co. for the purchase of said sewer upon the terms and conditions
hereinbefore set forth.
THE FOREGOING RESOLUTION is approved and signed by
me this 19th day of January, 1965.

do hereby certify that the foregoing resolution was passed and
adopted at a regular meeting of the City Council held
on the 19th day of January, 1965, by the following vote of
the members thereof:
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 19th day
of January, 1965.
