A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND ANAHEIM UNION HIGH SCHOOL DISTRICT,
WITH REFERENCE TO THE PAVING OF A PORTION OF
WAGNER STREET; AND RESCINDING RESOLUTION NO.
65R -367.
WHEREAS, Anaheim Union High School District is con-
structing a new high school located at 2200 East Wagner Street
in the City of Anaheim; and
WHEREAS, the school is to be financed with State Aid
funds, and Anaheim Union High School District is not able to pay
for any paving to exceed the width of 18 ft., including a deduc-
tion for existing paving; and
WHEREAS, Anaheim Union High School District's share of
paving on Wagner Street bordering the school is 7,938 square feet
of asphaltic concrete, including all grading, curbs, gutters,
sidewalks, driveways and 5 -foot minimum skin coat; and
WHEREAS, the City of Anaheim's share of paving on Wagner
Street is 15,660 square feet of asphaltic concrete; and
WHEREAS, the City Council did, heretofore, on May 18,
1965, adopt Resolution No. 65R -367 authorizing the execution of
an agreement between the City and said High School District,
providing for the letting of a contract by the City for said
street improvements on Wagner Street and for reimbursement by
said High School District for its share of said street improve-
ments, which contract was duly entered into between the parties
on May 27, 1965; and
WHEREAS, the City of Anaheim and Anaheim Union High
School District have determined that it will be more advantage-
ous and in the best interest of both parties if the contract for
said street improvements is let by the High School District and
reimbursement made by the City to said School District for the
City's share; and
WHEREAS, Anaheim Union High School District has tendered
to the City an agreement to be made and entered into between the
City of Anaheim and said School District, providing for the con-
struction of said street improvements on Wagner Street in the
manner determined to be more advantageous to both parties, as
hereinabove outlined.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement tendered to the City by
Anaheim Union High School District, providing for the letting
of a contract by Anaheim Union High School District for the
construction of street improvements on Wagner Street in accord-
ance with approved plans and specifications, and for reimburse-
ment by the City of its share of said paving, upon the terms and
conditions set forth in said agreement, be, and the same is
hereby approved; and that the Mayor and City Clerk be, and they
are hereby, authorized to execute said agreement for and on
behalf of the City of Anaheim.

BE IT FURTHER RESOLVED that Resolution No. 65R -367 be,
and the same is hereby, rescinded.
THE FOREGOING RESOLUTION is approved and signed by me
this 13th day of July, 1965.
