1965-524RESOLUTION NO. 65R -524 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 706 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from WALT DISNEY PRODUCTIONS, 500 S. Buena Vista Street, Burbank, California, Owner, and Wrather Hotels, Inc., 270 N. Canon Drive, Beverly Hills, California, Lessee, to permit the expansion of an existing high -rise hotel -motel building, the relocation of an existing sign, and a waiver of the maximum height limitation in an R -A, Agricultural Zone, upon the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Lots 1, 2, 3 and 4 in Block 14 of Fairview Colony Tract, as shown on a Map recorded in Book 1, page 33 of Miscellaneous Maps, records of Orange County, California. Excepting from said Lots 3 and 4 the following: Commencing at the point of intersection of the center line of the 60 -foot road as shown on said Map, adjoining Blocks 14 and 15 of said Fairview Colony Tract on the East, with the Easterly extension of the line common to said Blocks 14 and 15; thence South 89 45' 28" West along said extended line and along the line common to said Blocks 14 and 15, 620.29 feet to the true point of beginning of this description, said point being hereby designated as Point A; thence from said true point of beginning North 0 05' 20" West, 26.50 feet; thence South 89 45' 28" West 104.54 feet; thence South 0 05' 20" East, 26.50 feet to the line common to said Blocks 14 and 15; thence North 89 45' 28" East along said line 104.54 feet to the true point of begin- ning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on May 24 19 65 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1641 Series 1964 -65 granting__ Conditional Use Permit No. 706, sub --ject to certain conditions therein set forth and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said Conditional Use Permit and said appeal was set for public hearing on July 6, 1965, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Muni- cipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets aid high- ways designed and improved to carry the traffic in the area. 5. Revisions in the conditions th ich the City Planning Commission recommended be imposed in the granting of said Conditional Use Permit are necessary due to the following factors: (a) The Conditional Use Permit is to permit an addition to be added to an existing facility. No changes in the conditions recommended by the Planning Commission would have been considered for a new development. (b) The ultimate dedications for West Street and Cerritos Avenue were acquired at the time of original development, and since then the City's requirement has increased from 40 feet to 45 feet for a half street width. (c) To require addititional dedication would cause relocation of present landscaping, signs, service station facilities, fences, the loss of many parking spaces, and relocation of the monorail supports. -2- 6. The granting of the Conditional Use Permit under the conditions hereinafter imposed will not be detri- mental to the peace, health, safety and general wel- fare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting said Conditional Use Permit be, and the same is hereby sustained except as to certain of the conditions recom- mended, and more particularly referred to in Item 5 above; and that Conditional Use Permit No. 706 be, and the same is hereby, granted permitting the expansion of an existing high -rise hotel motel building, the relocation of an existing sign, and a waiver of the maximum height limitation in an R -A, Agricultural Zone, on the property hereinbefore described, subject to the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a variable strip of land, not to exceed 12 feet in width, along Walnut Street, for the southerly 175 feet of subject property, as required by the City Engineer, for street widening purposes. 2. That 4 -foot sidewalks shall be installed along West Street from the cross -walk north of the main driveway of the Disneyland Hotel to the south property line, excluding the service station site, and along Cerritos Avenue from Walnut Street to the most easterly driveway, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 3. That curbs and gutters shall be installed along the southerly 175 feet of Walnut Street, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 4. That the paving shall be installed along Walnut Street, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 5. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1 through 7. 8. That Condition No. 1 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. -3- 9. That Conditions Nos. 2, 3, 4, 5 and 6 above mentioned shall be complied with prior to final building in- spection. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
