1965-516RESOLUTION NO. 65R- 516 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUI- SITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES, AND ACCEPTING A GRANT DEED CONVEYING SAID PROPERTY TO THE CITY OF ANAHEIM. WHEREAS, UNION PACIFIC RAILROAD COMPANY, a Utah Corpora- tion, is the owner of the hereinafter described real property situated in the City of Anaheim, County of Orange, State of Cali- fornia; and WHEREAS, said owner has offered to sell said property to the City of Anaheim for the sum of $11,690.23 cash, lawful money of the United States; and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and acqui- sition of said real property for municipal purposes, and that the price which the owner thereof is willing to accept is reasonable and not out of proportion to the fair market value of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of UNION PACIFIC RAILROAD COMPANY, a Utah Corporation, to sell the hereinafter described real property to the City of Anaheim for the sum of $11,690.23 cash, lawful money of the United States, be and the same is hereby accepted, and that the deed conveying said real property situated in the City of Anaheim, County of Orange, State of California. more particularly described as follows: That portion of the South 15 acres of the SE 1/4 of the SE 1/4 of Section 3, T. 4 S., R. 10 W., S.B B.& M., described in deed to Los Angeles Salt Lake Railroad Company, recorded in Book 299, page 395 of Deeds, records of said County, bounded on the north by the southerly line of that certain parcel of land described in deed to Orange County Flood Control District, recorded in Book 4967, page 199, Official Records of said County, and bounded on the east by a line that is parallel with and distant 70.00 feet westerly, measured at right angles from the westerly line of that certain 100 -foot strip of land described in deed to California Central Railway Co., recorded in Book 6098, pages 393 to 398, both inclusive, Records of said County, and bounded on the south by a line, parallel with and distant 30.00 feet northerly, measured at right angles from the south line of said SE 1/4 of the SE 1/4 of Section 3. EXCEPTING from this grant and reserving unto the Grantor, its successors and assigns, forever, all minerals and all mineral rights of every kind and character now known to exist or hereafter discovered, including without limiting the generality of the foregoing, oil and gas and rights thereto, together with the sole, exclusive and perpetual right to explore for, remove and dispose of said minerals by any means or methods suitable to the Grantor, its successors and assigns, but without entering upon or using the surface of the lands hereby conveyed, and in such manner as not to damage the surface of said lands or to interfere with the use thereof by the Grantee. to the City of Anaheim, subject to the taxes for the fiscal year 1965 -66, and all conditions, restrictions, reservations, ease- ments and encumbrances of record, be, and the same is hereby accepted by the City Council of the City of Anaheim. BE IT FURTHER RESOLVED that the Director of Finance be, and he is hereby, authorized and directed to pay to the Union Pacific Railroad Company the sum of $11,690.23.
