1965-391RESOLUTION NO. 65R -391 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 63R -729 IN RECLASSIFICATION PROCEEDINGS NO. 62 -63 -131. WHEREAS, the City Council did heretofore, to wit, on September 10, 1963, adopt Resolution No. 63R -729 in Reclassifi- cation Proceedings No. 62 -63 -131 finding and determining that the property and area therein described should be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in C -1, NEIGHBORHOOD COMMERCIAL ZONE and R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, as more particularly set forth in said resolution, subject to certain conditions specified therein; and WHEREAS, Condition No. 3 of Resolution No. 63R -729 reads as follows: "3. That all vehicular access rights to Orangewood Avenue, except at dedicated street and /or alley openings, shall be dedicated to the City of Anaheim." WHEREAS, the City Council finds that said condition should be amended to provide that vehicular access rights to Orangewood Avenue from Lots 2, 3 and 4 of Tract No. 5302, except at dedicated street openings, be dedicated to the City; and WHEREAS, Condition No. 4 of Resolution No. 63R -729 reads as follows: "4. That subject property shall be developed substan- tially in accordance with Exhibits Nos. 1 through 18, Revision No. 1, on file with the City of Anaheim." AND WHEREAS, the City Council finds that said condition should be amended to provide that Parcel "B" of subject property be developed substantially in accordance with Exhibits Nos. 1 through 18, Revision No. 1, on file with the City of Anaheim, as they apply to the Parcel "B and that Parcel "A" of subject property be developed in accordance with C -1 Site Development Standards and /or Service Station Standards. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 63R -729 in Reclassifica- tion Proceedings No. 62 -63 -131 be, and the same is hereby amended by amending Conditions 3 and 4 thereof to read as follows: "3. That all vehicular access rights to Orangewood Avenue from Lots 2, 3 and 4 of Tract No. 5302, except at dedicated street openings, shall be dedicated to the City of Anaheim. "4. That Parcel 'B' of subject property shall be developed substantially in accordance with Exhibits Nos. 1 through 18, Revision No. 1, on file with the City of Anaheim, as they apply to -1- 62 -63 -131 BE IT FURTHER RESOLVED that in all other respects said resolution be, and remain in full force and effect. THE FOREGOING RESOLUTION is approved and signed by me this 1st day of June, 1965. ATTEST: Parcel 'B'; and that Parcel 'A' of subject property shall be developed in accordance with C -1 Site Development Standards and /or City of Anaheim Minimum Service Station Site Development Standards." (SEAL) AYES: COUNCILMEN: Dutton, Schutte and Pebley NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Chandler and Krein CITY CLERK OF THE CITY OF ANAHEIM RESOLUTION NO. 65R- 390 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON- MENT OF A PORTION OF MILLER STREET AND AN EASEMENT FOR STREET PURPOSES UPON, OVER, ACROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROP- ERTY. WHEREAS, the City Council of the City of Anaheim, a Municipal Corporation of the State of California, did on the llth day of May, 1965, pass its Resolution No. 65R -356, entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLAR- ING ITS INTENTION TO VACATE AND ABANDON A PORTION OF MILLER STREET AND AN EASEMENT FOR STREET PURPOSES UPON, OVER, ACROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROPERTY; FIXING A TIME AND PLACE FOR A HEARING THEREON; AND DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS RESOLUTION," whereby it declared its intention to vacate and abandon and close to public use a portion of Miller Street and an easement for street purposes upon, over, across and along the hereinafter described property under the provisions of the Street Vacation Act of 1941; and WHEREAS, the City Council in said resolution referred to a map on file in the Office of the City Clerk for further particulars as to the proposed vacation, abandonment and closing to public use of said portion of Miller Street and easement for street purposes; and WHEREAS, said City Council did by said resolution fix the 1st day of June, 1965, at 1 :30 o'clock P.M., in the Council Chamber in the City Hall of the City of Anaheim as the time and place for a public hearing on the matter of such vacation, abandonment and closing to public use of said portion of Miller Street and easement for street purposes, for all persons inter- ested in or objecting to such proposed vacation, abandonment and closing to public use to appear and show cause, if any they had, why such portion of street and easement for street purposes should not be vacated, abandoned and closed to public use; and WHEREAS, said resolution was published on the 20th day of May, 1965, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, County of Orange, State of California; and WHEREAS, by said resolution said City Council directed that notices of the passage of said resolution and of the time and place of the hearing on the matter of the vacation, aban- donment and closing to public use of said portion of street and easement for street purposes be posted conspicuously along the line of said portion of street and easement, not more than 300 feet apart, at least ten (10) days before said hearing, and that not less than three (3) such notices should be posted; and WHEREAS, Donald R. O'Donnell did on the 20th day of May, 1965, post conspicuously not less than three (3) such notices along the line of said portion of road and easement, which notices were posted less than 300 feet apart, and were posted at least ten (10) days before said hearing; and -1- c (1 WHEREAS, said City Council did on the 1st day of June, 1965, at 1 :30 o'clock P.M., at said City Hall, conduct a public hearing on the matter of whether said portion of street and easement for street purposes, hereinafter described, should be vacated, abandoned and closed to public use, and at said hearing did hear evidence thereon; and WHEREAS, the City Council finds from all evidence submitted that said portion of street and easement for street purposes described in the Resolution of Intention and hereinafter described, are unnecessary for present or prospective street purposes and that an order vacating and abandoning such portion of street and easement should be made. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds the recitals hereinabove set forth in this resolution to be true; 2. That it finds from all evidence submitted that said portion of Miller Street and easement for street purposes described in said resolution are unnecessary for present or prospective public purposes; 3. That it does hereby order that said portion of Miller Street and easement for street purposes be, and they are hereby, vacated, abandoned and closed to public use; 4. That said portion of street and easement herein ordered vacated, abandoned and closed to public use are that certain portion of Miller Street and easement described in said Resolution No. 65R -356, are situated in the City of Anaheim, County of Orange, State of California, and are more particu- larly described as follows: That certain portion of the existing dedicated street, commonly known as Miller Street, described as: The Easterly 1.39 feet of the Westerly 45.00 feet of the East half of the North half of Lot 17, Block K, Kraemer Tract, as shown on a Map recorded in Book 12, pages 87 and 88 of Miscellaneous Records of Los Angeles County, California.
