1965-274WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 64 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 6th day of April 19 65 as the time, and the City Council Chambers in the City Tria of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: RESOLUTION NO. 65R 274 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. -1- 64 -65 -97 That portion of Vineyard Lot "C -1," in the City of Anaheim, County of Orange, State of California, as per Map recorded in Book 4, Pages 629 and 630 of Deeds, in the Office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the Northeast corner of said lot; thence South 15 27' 00" East 360.14 feet along the Easterly line of said lot to the Easterly prolongation of the Northerly line of Lot 67 of Tract No. 2723, as shown on a map recorded in Book 84, Pages 19, 20 and 21 of Miscellaneous Maps, in the Office of the County Recorder of said Orange County; thence South 74 29' 45" West 236.93 feet along the Northerly line of said Lot 67 and its Easterly and Westerly prolongation to the Easterly line of Rose Street, as shown on said map of Tract No. 2723; thence North 15 30' 15" West 341.63 feet along said Easterly line to the beginning of a tangent curve thereon concave Southeasterly, having a radius of 15.00 feet and a central angle of 90 00' 00 thence Northerly, Northeasterly and Easterly 23.56 feet along said curve; thence North 15 30' 15" West 3.50 feet to the Northerly line of said Vineyard Lot "C -1 thence North 74 29' 45" East to the point of beginning. EXCEPT the interest in any portion thereof included within the East 2.50 feet of said Lot "C -1" conveyed to the City of Anaheim by deed recorded March 1, 1924 in Book 512, page 255 of Deeds of said Orange County. be excluded from R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, and in- corporated in C -1, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Sycamore Street for street widening purposes, including 15 -foot radius corner returns at East and Rose Streets. 2. (a) That all engineering requirements of the City of Anaheim along Sycamore and East Streets, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, side- walks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the in- stallation of said engineering requirements. 3. That the curbs along East Street shall be removed and/ or reconstructed, as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the Office of the City Engineer. 4. That the sidewalks along repaired, as required by accordance with standard on file in the Office of 5. That all vehicular access rights to Rose Street shall be dedicated to the City of Anaheim. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along East and Sycamore Streets, for street lighting purposes. 7. That the owners of subject property shall pay to the City of Anaheim the sum of 15 per front foot along East, Sycamore and Rose Streets, for tree planting purposes. 8. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Super- intendent of Streets, prior to final building inspection. 9. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1 and 2; PROVIDED, HOWEVER, that no access shall be permitted to Rose Street nor to the alley. 10. That all air conditioning facilities shall be properly shielded from view from abutting streets, prior to final building inspection. 11. That trees of sufficient height to obscure the load- ing dock from the apartment building shall be planted along the southerly boundary of subject property; and that said trees and the planting thereof shall be subject to the approval of the Parkway Maintenance Superintendent. 12. That Conditions Nos. 1, 2(b), 3, 4, 5, 6 and 7 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
