1965-268RESOLUTION N0. 65R -268 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRITORY AS THE JOHNSON ANNEXATION D S RIB G BO, BAR 0 TH T RR TORY PRS'OSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Council of the City of Anaheim did on the 6 th day of April 19 65 receive a written petition asking that certain new terra ory described in said petition be annexed to the City of Anaheim; and WHEREAS, prior to the circulation or filing of said petition, notice of intention to annex said territory, containing the specific boundaries of the territory to be annexed, was filed with the Local Agency Annexation Commission; and WHEREAS, said Local Agency Annexation Commission has rendered its decision, as provided in Section 54766 of the Govern- ment Code, approving said annexation; and WHEREAS, before the filing of said petition, the pro- posal for the annexation of the territory hereinafter described to the City of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim and is un- inhabited territory, and said petition contained a description of said territory in words and figures as hereinafter in this Resolution described; and WHEREAS, the City Council finds from evidence and reports received that at the time of the filing and receipt of said petition, it was and now is signed by owners of not less than one fourth (k) of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding equalized county assessment roll; and WHEREAS, the City Council finds from evidence and reports received and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to said City of Anaheim did not form a part of any municipal corporation and that said territory was uninhabited and is contiguous to the City of Anaheim; and WHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: February 25, 1965 REVISED PROPOSED ANNEXATION TO THE CITY OF ANAHEIM JOHNSON ANNEXATION --That parcel of land located in the County of Orange, State of California, described ,s follows: Beginning at a point in the existing City Limit line of the City of Anaheim, as estab- lished by the Peralta Hills Annexation passed by Ordinance No. 1688, March 27, 1962, filed with the Secretary of State April 27, 1962 and recorded May 2, 1962 in the office of the County Recorder of Official Records of Orange County, California, said point of begin- ning being the intersection of the Southerly right of way line of the Santa Ana Valley Irrigation Company Canal, as shown on a Record of Survey filed in Book 4, page 45 of Record of Surveys in the office of the County Recorder of said Orange County, California, with the Southeasterly prolongation of the East line of the J. D. Taylor Tract, as shown on a Map recorded in Book 5, page 16 of Miscellaneous Maps, records of Orange County, California, as said intersection is referred to in the above mentioned Peralta Hills Annexation, said Southerly right of way line of the Santa Ana Valley Irrigation Company Canal also being, for the purpose of this description, the Northerly line of Santa Ana Canyon Road, as shown on said Record of Survey; thence 1. Leaving the said existing City of Anaheim City Limit line and following along a portion of the said Southerly right of way line of the said Santa Ana Valley Irrigation Company Canal, also being a portion of the Northerly line of said Santa Ana Canyon Road, the following courses and distances: North 50 51° 45" East 297 feet, more or less, to the beginning of a tangent curve concave Southeasterly and having a radius of 630 feet; thence Northeasterly along said curve through a central angle of 30 31' 15" an arc distance of 335.42 feet; thence tangent to said curve North 81 23' 00" East 50.69 feet to an inter- section with the Easterly right of way line of that certain street known as Addington Drive, 60 feet wide, as shown on a Map of Tract No. 5000, recorded in Book 191, pages 28, 29 and 30 of Miscellaneous Maps, records of Orange County, California; thence 2. Leaving the Santa Ana Valley Irrigation line, and said Northerly line of Santa Ana Canyon Road, along a portion of the East right of way line of said Addington Drive, 60 feet de, North 18 04' 32" West, a distance of 160.70 feet; thence 3. Leaving the Easterly right of way line of Addington Drive, along the following courses and distances: North 81 24' 15" East 226.24 feet to the beginning of a tangent curve concave Northerly and having a radius of 461.30 feet; thence Easterly along said curve through a central angle of 2 31' 12" an arc distance of 20.30 feet; thence North 11° 06° 57" West 60.00 feet; thence North 13 58° 59" West 112.61 feet; thence South -2- Revised Proposed Annexation to the City of Anaheim Johnson Annexation Continued February 25, 1965 81 24' 15' West 284.93 feet; thence North 8 35' 45" West 172.50 feet; thence South ,1 24' 15" West 4.27 feet; thence North 8 35' 45" West 112.50 feet; thence South 81 24' 15" West 40.93 feet; thence North 8 35' 45" West 172.50 feet; thence South 8 24' 15" West 14.22 feet; thence North 23 22' 26" West 116.46 feet; thence South 73 08' 06" West 13.13 feet; thence North 29 45 20" West 172.94 feet; thence North 60° 14' 40" East 1.98 feet to the beginning of a tangent curve concave Southerly and having a radius of 428 feet; thence Easterly along said curve through a central angle of 2 48° 53" an arc distance of 21.02 feet to the beginning of a reverse curve concave Northwesterly and having a radius of 90 feet; thence Easterly along said reverse curve through a central angle of 3 48' 35" an arc distance of 5.98 feet; thence North 29 45' 20" West 223.35 feet; thence North 56 30' 10" East 42.39 feet; thence North 33 29' 50" West 172.50 feet; thence North 56 30' 10" East 13.42 feet; thence North 33 29' 50" West 355.63 feet; thence North 51 59' 22" East 11.58 feet; thence North 38 00' 38" West. 98 feet, more or less, to an intersection with the Southeasterly line of the existing City Limit line of the City of Anaheim as established by the Northeast Annexation No. 3 passed by Ordinance No. 1542, January 17, 1961, filed with the Secretary of State July 10, 1964 and recorded in the office of the County Recorder of Official Records of Orange County, California, July 17, 1964; thence 4. Following along a portion of the last mentioned existing City of Anaheim City Limit lines the following courses and distances: South 46 00' 00" West 114 feet, more or less, South 84 40' 00" West 380 feet, more or less, to an intersection with the exist- ing City of Anaheim City Limit line as established by the aforementioned Peralta Hills Annexation, said point of intersection being in a line bearing North 51° 47° 30" East and distant 387 feet, more or less, from a point in the East line of the J. D. Taylor Tract, the last mentioned point being distant 15.13 feet Southerly of the Northeast corner of said J. D. Taylor Tract, as shown on a Map recorded in Book 5, page 16 of Miscellaneous Maps, records of Orange County, California; thence ollowing along a portion of the existing City of Anaheim City Limit line as established by said Peralta Hills Annexation the following courses and distances: South 51 47° 30" West 387 feet, more or less, South 29° 45' 15" East 2,002 feet, more or less, to the point of beginning. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that such proposed annexation be designated as JOHNSON ANNEXATION and that notice of su I proposed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this resolution, unless the owner or owners of all of the territory to be annexed have petitioned for annexation or filed their consents to such annexation, in writing, with the City Council in which event the hearing shall be set at any time after compliance with Section 35311 of the Government Code. AND BE I.T FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have not petitioned for annexation or filed their con- sents to such annexation, in writing, with. the City Council. BE IT FURTHER RESOLVED that the 18th day of May 196 5 at the hour of 7:00 o'clock P.M., at the City Council Chair in the City Hall of the City oT be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner or owners of real pro- perty within the territory proposed to be annexed; and that at any time before the closing of said hearingon protests, any owner of property within said territory may file with the City Clerk a written protest against the annexation. Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit The Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circulation, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit the Placentia Courier and that such pub- lication s a •e comp ete• at east twenty ;'S) days prior to the date of hearing hereinabove specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County. The foregoing notices shall be given not less than twenty (20) days before the first public hearing on the proposed annexation.
