1965-727RESOLUTION NO. 65R -727 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 7305 IN RECLASSIFICATION PROCEEDINGS NO. 61- 62 -23. WHEREAS, the City Council did heretofore, to wit, on October 31, 1961, adopt Resolution No. 7305 in Reclassification Proceedings No. 61 -62 -23 finding and determining that the prop- erty and area therein described should be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE, to C -1, NEIGHBORHOOD COMMERCIAL ZONE, subject to certain conditions set forth in said resolution; and WHEREAS, Condition No. 1 of Resolution No. 7305 reads as follows: That subject property shall be developed substan- tially in accordance with plans marked 'Exhibits 1, 2 and 3,' signed by G. G. Fry, and on file with the City of Anaheim, with the exception that said plans shall be amended to provide for a four -foot planting area against the north wall, and that thick shrubbery, which will grow to a height above said wall, shall be planted and maintained in said four -foot area. That said plans shall be further amended to include two openings on Monterey Street for ingress and egress, but prohibiting any openings within the north 88 feet of subject property. That no buildings shall be placed within 120 feet of the northerly property line. That final plans of development shall be submitted to and approved by the Building and Planning Depart- ments of the City." AND WHEREAS, on or about August 25, 1965, the City Council did receive a request from Alfred J. Bodor Associates, representative of Nation Wide Shoes, asking for a waiver from the 120 -foot setback from the north property line as required by said Condition No. 1; and WHEREAS, said request for amendment of Condition No. 1 of said resolution was set for public hearing before the City Council on October 5, 1965, and notice of such public hearing was duly given as required by law; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such hearing and did give all persons interested therein an opportunity to be heard, and did thereupon consider all evidence and reports offered at said hearing; and WHEREAS, the City Council does find and determine that Condition No. 1 of said resolution should be amended as hereinafter set forth. 111 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 7305 in Reclassifi- cation Proceedings No. 61 -62 -63 be, and the same is hereby, amended by amending Condition No. 1 thereof as follows: -1- 61 -62 -23 BE IT FURTHER RESOLVED that in all other respects said Resolution No. 7305 be, and remain in full force and effect. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Condition No. 1 of Ordinance No. 2000 in Reclassification Proceedings No. 61 -62 -23 in accordance with this resolution. THE FOREGOING RESOLUTION is approved and signed by me this 5th day of October, 1965. ATTEST: "That the development plans received in the Office of the City Clerk on August 25, 1965 and presented to the City Council this date, be and the same are hereby approved, and that the setback as contained in said plans be and the same is hereby approved, retaining the 4 -foot planting area against the north wall, the plantings in said area to consist of trees grown to a height of 12 to 15 feet, which shall be subject to approval of the Superintendent of Parkway Maintenance."
