1965-690WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from AGAJANIAN INVESTMENT CORPORATION and SANTA ANITA INVESTMENTS, INCORPORATED, 13571 Harbor Boulevard, Garden Grove, California, to permit the establishment of a multiple-family planned residen- tial development with a waiver of the Anaheim Municipal Code requirement that all dwelling units be located within 200 feet of a standard street, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: RESOLUTION NO. 65L-690 -1 A LLSOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GLANTING CONDITIONAL USE PEKMIT NO. 732. PARCEL 1. That portion of the Last half of the Last half of the Southeast quarter of Section 27, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southeast corner of Tract No. 1965, as shown on a Map recorded in Book 105, pages 27 and 28 of Miscellaneous Maps, records of Orange County, California; thence North 89 38' 00" West along the South line of said Tract No. 1965, a distance of 660.26 feet to a point in the West line of the East half of the Northeast quarter of said Southeast quarter; thence South 0 41' 47" East along said West line and its Southerly prolongation 279.84 feet to a point in the North line of Lot 69 of Tract No. 2520, as shown on a Map recorded in Book 88, pages 11 through 15 inclusive of Miscellaneous Maps, records of Orange County, California; thence South 89 38' 14" Last along the North line of said Lot 69 and along its Easterly prolongation 660.24 feet to a point in the East line of said Southeast quarter; thence North 0 41' 27" West along said Last line 279.79 feet to the point of beginning. EXCEPTING THEREFROM that portion thereof described as follows: Commencing at a point on the East line of said Southeast quarter, said point being North 0 41' 27" West 172.60 feet from the Southeast corner of the Northeast quarter of said Southeast quarter; thence South 86 02' 38" West 48.00 feet to the true point of beginning; thence South 3 57' 22" East 26.50 feet, thence North 86° 02' 38" Last 41.50 feet to the true point of beginning. PARCEL 2. That portion of the East half of the Northeast quarter of the Southeast quarter of Section 27, Township 4 South, Lange 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Commencing at a point on the East line of said Southeast quarter, said point being North 0 41' 27" West 172.60 feet from the Southeast corner of the Northeast quarter of said Southeast quarter; thence South 86 02' 38" West 48.00 feet to the true point of beginning thence South 3 57 22" Last 26.50 feet; thence South 06 02' 38" West 41.50 feet; thence North 3 57' 22" West 26.50 feet; thence North 66 02' 38" Last 41.50 feet to the true point of beginning. AND WHEREAs, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on August 2, 1965, notices of which said public hear- ing were duly given as required by law and the provisions of Title 18, Chapter 16.76 of the Anaheim Municipal Code; and WHEC.EAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1723, 6eries 1965-66, denying Conditional Use Permit No. 732; and WHLREAS, thereafter, within twenty-two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said conditional use permit and did thereupon fix the 7th day of September, 1965, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title IC, Chapter 12.76 of the Anaheim Municipal Code; and WHLaEAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the ads:oining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. The ranting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anahem- NLT, THESSFbE, SE IT ,.kS3LVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission denying said conditional use permit be, and the same is hereby disapproved, ane that Conditional Use Permit No. 732 be, and the same is hereby, granted permitting the establishment of a multiple-family planned residential development and permittin a waiver of the Anaheim Municipal Code requirement that all dwelling units be located within two hundred feet of a standard street, on the property hereinbefore described, subject to the followin conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Juperintendent of Streets, prior to final building inspection. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final buildincl inspection. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation. purposes, said amount to be paid at the time the building permit is issued. 4. That this conditional use permit is granted subject to the completion of Leclassification Proceedings No. 65-66-21 now pend5n. 5. That subject property shall be developed substantially in accordance with plans and specif:cations on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3. (Plans to be amended to reflect 66 off-street parking spaces, and block walls, as included in specifications and inadvertently omitted from plans submitted.) The City Council hereby reserves the right to revoke such conditional use permit for good cause or failure of sail owners, their successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
