1965-652RESOLUTION NO. 65A-652 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 723 WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from VOGL, INC., 7601 Crenshaw Boulevard, Los Angeles, California, to establish a service station within 75 feet of a residential zone, at the intersection of a local street and an arterial highway, on the following described property situated in the City of Anaheim, State of California, to wit: That portion of Lot 16 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hamel and filed in the office of the County Recorder of Los Angeles County, California, a copy of which is shown in Book 3, page 163, et seq., entitled "Los Angeles County Maps," records of said Orange County, described as follows: Beginninc at a point on the center line of South Street North 74 36' 05" East 111.50 feet from the northwest corner of the land conveyed by deed recorded October 28, 1947 in Book 1590, page 187 of Official Records, said corner being South 74 36' 05" West 373.10 feet from the intersection of said center line with the center line of Placentia Avenue; thence South 15 45' 25" East 188.73 feet, parallel with the West line of said land to the northwesterly line of the land described in the deed to William H. Grebel, et ux, recorded July 3, 1948 in Book 1663, pages 397 and 39C of ()racial Records; thence North 74 36' 05" East to the northeast corner of said land; thence North 0 05' 15" West 195.84 feet along said center line of Placentia Avenue to said center line of South Street; thence South 74 36' 05" West 261.60 feet to the point of beginning. EXCEPT that portion thereof that lies within the lines of South Street, as shown on said map. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on July 19, 1965 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 1702 Series 1965-66, denying Conditional Use Permit No. 723 and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said Conditional Use Permit and said appeal was set for public hearing on August 24 19 65 at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hear- ing, that Conditional Use Permit No. 723 should be denied NOW THEREFORE, the City of Anaheim that mission denying and the same is hereby VOGE, INC. for a Conditional Use Permit to establish a service station within 75 feet of a residential zone, on the property hereinbefore described, be and the same is hereby denied. this ATTEST: THE FOREGOING RESOLUTION is approved and signed by me 1 9 65 24th day of August )r. 7 2� CIT CLERK OF THE CITY OF ANAHEIM BE IT RESOLVED by the City Council of the action of the City Planning Com- Conditional Use Permit No. 723 be, sustained and that the request of MAYOR OF THE CITY 0 ANAHEIM STATE OF CALIFORNIA COUNTY OF ORANGE CITY OF ANAHEIM I, DENE M.
