RESOLUTION No. 65R- 650
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND THE COUNTY OF ORANGE WITH REFERENCE
TO THE IMPROVEMENT OF ORANGEWOOD AVENUE.
WHEREAS, the City of Anaheim intends to improve portions
of Orangewood Avenue from State College Boulevard to the East
City Limits under the Arterial Highway Financing Program, Pro-
ject No. 294; and
WHEREAS, the County of Orange proposes to improve
Orangewood Avenue from the East Anaheim City Limits to the Santa
Ana River and said roadway lies entirely within an unincorporated
area of the County but is contiguous with said proposed improve-
ment of Orangewood Avenue by the City; and
WHEREAS, the City has offered to design, contract and
inspect the construction of said County portion of roadway in
conjunction with its work under Arterial Highway Financing Pro-
gram Project No. 294; and
WHEREAS, the City and the County consider it in the
best interest of economics and public safety to combine the
construction of said County portion of roadway with City's
Arterial Highway Financing Program Project No. 294; and
WHEREAS, the County of Orange has tendered to the City
of Anaheim a form of agreement to be made and entered into between
the parties providing for the construction of the County's por-
tion of said roadway in conjunction with the City's work under
said Arterial Highway Financing Program; and
WHEREAS, the City Council finds that the terms and
conditions of said agreement are fair and reasonable, and that
said agreement should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement tendered to the City to
be made and entered into by and between the City of Anaheim and
the County of Orange, providing for the combined construction of
the County's portion of roadway above mentioned and the City's
Arterial Highway Financing Program Project No. 294 upon the terms
and conditions and for the proportionate costs set forth in said
agreement, and as hereinafter set forth, be and the same is hereby
approved. Said terms and conditions are as follows:
A. Be designated as Project Engineer, Contracting
and Construction Agent for the parties to do and
perform all things necessary in order to design and
construct said County portion, said portion presently
being Orangewood Avenue between the East City Limits
of Anaheim and the County's proposed Orangewood
Avenue Bridge at the Santa Ana River and being
approximately one hundred fifty (150) feet in length;
and to execute and deliver all documents required

in connection with the construction and completion
of said project including Certificate of Cost and
Certificate of Completion of Project.
B. During the period of construction have jurisdiction
over the construction area including that portion
described above within County territory.
2. COUNTY SHALL:
A. Acquire the necessary right of way for County's
portion of the project, certify acquisition of said
right of way to City prior to construction.
B. Approve the plans and specifications as to design
and construction features affecting the construc-
tion, operation and maintenance of the portion of
the project within County.
C. At all time during the progress of construction of
said portion of roadway on Orangewood Avenue have
access to the work thereon for the purpose of in-
spection thereof, and should County deem any
remedial measures to be necessary, County shall
notify City thereof.
3. The estimated cost of the construction of said County
portion of roadway is approximately $5,500 including engineer
ing charges.
4. Upon completion of construction of said portion of road-
way, the City shall submit full, true and correct copies of
documents, certificates and itemized bills including actual
cost of engineering applicable to said County portion, to
the County and the County shall reimburse City within thirty
(30) days upon submission of such costs.
5. County's share of the construction cost shall be deter-
mined on the basis of the amount of work done on said portion
of roadway lying within the boundaries of unincorporated
territory, as these boundaries exist at the time of adver-
tising the project.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 24th day of August, 1965.
