1965-586RESOLUTION NO. 65R-586 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING SECTION 18.62.155 OF THE ANAHEIM MUNICIPAL CODE; AND DIRECTING THE CITY CLERK TO TAKE THE NECESSARY STEPS TO EFFECT SAID AMENDMENT. WHEREAS, the City Council did on December 29, 1964 adopt Ordinance No. 2072 amending Title 18 of the Anaheim Municipal Code by adding thereto Chapter 18.62, Sections 18.62.010 to 18.62.230, both inclusive; and WHEREAS, Section 18.62.155, as added to the Anaheim Municipal Code by Ordinance No. 2072, reads as follows: "Notwithstanding any provisions of Chapter 18.62, when any commercial use is permitted to be made of a structure originally designed or intended for residential use, only one (I) unlighted free standing or wall sign of a maximum area of eight (8) square feet shall be permitted on the premises. Nothing contained herein shall be construed as permitting any type of sign or other advertising struc- ture in conjunction with a commercial use allowed as a home occupation." AND WHEREAS, on May 11, 1965, the City Council adopted Ordinance No. 2143 amending said Section 18.62.155 to read: "The commercial use of a structure originally designed or intended for residential use shall not be subject to the sign restrictions of this Section if authority for such commercial use is granted pursuant to Title 18 and, in the opinion of the Chief Building Inspector or his designated representative, there has been significant alterations in the pre existing external residential appearance of said structure. Any determination as to such external alterations made by the Chief Building In- spector or his authorized representative shall be subject to review by the City Council if review is requested by any person aggrieved by the decision of the Chief Build- ing Inspector or his authorized representative." AND WHEREAS, it was the intention of the City Council to amend said Section 18.62.155 as added to the Anaheim Municipal Code by Ordinance No. 2072 by adding thereto an additional para- graph; however, through inadvertence, the original paragraph was deleted and the wording contained in Ordinance No. 2143 substituted therefor; and WHEREAS, the City Council finds that Section 18.62.155 of the Anaheim Municipal Code should, therefore, be amended in accordance with the findings and intention of the City Council. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Section 18.62.155 of the Anaheim Municipal Code be, and the same is hereby amended to read as follows: -1- "(a) Notwithstanding any provisions of Chapter 18.62, when any commercial use is permitted to be made of a structure originally designed or intended for residential use, only one (1) unlighted free standing or wall sign of a maximum area of eight (8) square feet shall be permitted on the premises. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to take the necessary steps to correct Section 18.62.155 of the Anaheim Municipal Code to reflect the intention of the City Council as hereinabove outlined.
