A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 713
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a conditional use permit from
Pallmall Properties, Inc., P. 0. Box 7, Anaheim, California, to
establish a walk -up restaurant, and permitting a waiver of the
block wall requirement at the rear of the 3 -foot planting strip,
and the required landscaping around the restaurant, on the
following described property situated in the City of Anaheim,
State of California, to wit:
The northerly 219.75 feet of the southerly 225.00
feet of that portion of Lot 1 of Anaheim Extension,
in the City of Anaheim, County of Orange, State
of California, as shown on a map of Survey made by
William Hamel and filed in the Office of the County
Recorder of Los Angeles County, California, a copy
of which is shown in Book 3, page 163, et seq.,
entitled "Los Angeles County Maps," in the Office
of the County Recorder of said Orange County, lying
westerly of a line parallel with and South 74 31' 10"
West 815.00 feet from the easterly line of said lot.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on June 21 19 65 notices of which said
public hearing were duly given as r' equired by law and the pro-
visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code;
and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. 1677 Series 1964 -65
denying Conditional Use Permit No. 713
and
WHEREAS, thereafter, within twenty -two days from the
date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action of the City
Planning Commission in denyin said conditional use
permit and did thereupon fix t 20th day of July
19 65 as the time and the Council Chamber in the City Hall

of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 713 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion denying Conditional Use Permit No. 713 be, and the
same is her sustained and that the request of Pallmall
Properties Inc. for a conditional use permit to establish a
walk -up restaurant and permitting a waiver of block wall require-
ment at the rear of the 3 -foot planting strip, and a waiver of
the required landscaping around the restaurant, and the property
hereinbefore described, be, and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 3rd day of August
