A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN AGREEMENT FOR PURCHASE AND SALE
OF AN EASEMENT FOR SEWER LINE, WATER LINE AND
WALKWAY PURPOSES.
WHEREAS, Southern California Edison Company is the
owner of the hereinafter described real property situated in the
City of Anaheim, County of Orange, State of California; and
WHEREAS, the City Council finds that public convenience
and necessity require the purchase and acquisition of an easement
for sewer line, water line and walkway purposes in, on, under and
across said real property; and
WHEREAS, Southern California Edison Company has offered
to sell an easement in, on, under and across said real property
to the City of Anaheim for the sum of $2,640.00, upon the terms
and conditions set forth in a certain "Agreement for Purchase
and Sale of Easement for Sewer Line, Water Line and Walkway"
dated July 27, 1965, and this day submitted to the City Council;
and
WHEREAS, the City Council finds that the price which
the owner is willing to accept for said easement is reasonable
and that it would be to the advantage and best interest of the
City to accept said offer and purchase said easement upon the
terms and conditions set forth in said agreement.
NOW, THEREFORE,BE IT RESOLVED by the City Council of
the City of Anaheim that the "Agreement for Purchase and Sale of
Easement for Sewer Line, Water Line and Walkway" dated July 27,
1965, and this day submitted to the City Council by Southern
California Edison Company, wherein Southern California Edison
Company agrees to sell and the City agrees to purchase an ease-
ment for sewer line, water line and walkway purposes in, on,
under and across the following described real property situated
in the City of Anaheim, County of Orange, State of California,
to wit:
The Easterly 8.00 feet of the Westerly 393.67 feet of
the Southerly 175.00 feet of Lot 20, Tract No. 190, as
per map recorded in Book 23, page 50, of Miscellaneous
Maps, in the office of the County Recorder of said County.
SUBJECT TO:
That certain unrecorded agricultural license granted to
J. W. McMichael, et al., dated December 1, 1961, from
Southern California Edison Company.
Covenants, conditions, restrictions, reservations, rights,
encumbrances, easements and licenses affecting the above
described real property, whether of record or not, in-
cluding but not limited to those herein referred to.
for the sum of $2,640.00, upon the terms and conditions set
forth in said agreement, be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.
BE IT FURTHER RESOLVED that the Finance Director be,
and he is hereby, authorized to deliver to Southern California
Edison Company the sum of $2,640.00 at the time the above
mentioned easement is delivered to, and accepted by the City.
THE FOREGOING RESOLUTION is approved and signed by me
this 27th day of July, 1965.
