1965-958RESOLUTION NO. 65R -958 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 788. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from JACK C. DUTTON, 921 Pioneer Anaheim, California, to establish an existing on -sale liquor establishment and related commercial uses in conjunction with an existing restaurant as a conforming use, and to permit the future addition of a motel and luau building, and related commercial shops, on the follow- ing described property situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1. Beginning at the Northeast corner of Section 3, in Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 7 of Miscellaneous Maps, records of Orange County, California, running thence West along the North line of said Section 346.5 feet; thence at right angles South 660. feet; thence at right angles East 346.5 feet to a point on the East line of said Section; thence North along said East line, 660 feet to the point of beginning. Excepting therefrom the North 185 feet of the East 175 feet thereof. PARCEL 2. Beginning at a point in North line of said Northeast quarter of the Northeast quarter distant thereon 346.5 feet West from the Northeast corner of said Section, and running thence at right angles South 660 feet; thence at right angles West 132 feet; thence at right angles North 660 feet; thence East 132 feet to the point of beginning. EXCEPTING therefrom the Westerly 76 feet. ALSO EXCEPTING therefrom the Southerly 330 feet of the Easterly 20 feet of the Westerly 96 feet. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on November 22, 1965, notices of which said public hearing were fuly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1866 Series 1965 -66, granting Conditional Use Permit No. 788, subject to certain conditions therein set forth; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 21st day of December, 1965, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were fuly given as -1- required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not deterimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis sion in granting said conditional use permit be, and the same is hereby sustained and that Conditional Use Permit No. 788 be, and the same is hereby, granted permitting nt the establishment of an existing on -sale liquor establishment related commercial uses in conjunction with an existing restaurant as a conforming use, and permitting the future addi- tion of a motel and luau building, and related commercial shops, on the property hereinbefore described, subject to the following conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Orangethorpe Avenue and East Street, for street light- ing purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Orangethorpe Avenue and East Street, for tree planting purposes. 3. That all construction. €hall conform to the Uniform Building Code as adopted by the City of Anaheim. 4. That sidewalks shall be installed along Orangethorpe Avenue and East Street, as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the Office of the City Engineer. 5. That installation of said sidewalks along Orange thorpe Avenue and East Street shall be waived until such time as the construction of sidewalks in the area require their installation and such installa- tion is requested by the City Engineer. 6. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. 8. That all air conditioning facilities shall be prop- erly shielded from view from abutting streets, prior to final building inspection. 9. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3; provided, however, that the building setback requirements of the M -1, Light Industrial Zone Site Development Standards shall be maintained. 10. That Conditions Nos. 1 and 2 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
