1965-956RESOLUTION NO. 65R -956 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1743 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for Zoning variance from ELLA M. RICE owner o cer a n rea proper y s uated n t o ty o na e m, ounty of Orange, State of California, described as follows: The north half of the west half of the south half of the southwest quarter of the northwest quarter of Section 16, Township 4 South, Range 10 West, being Lot 13 of Helen and Lynch's Subdivision of the west half of Section 16, Township 4 South, Range 10 West, of the San Bernardino Meridian, in the City of Anaheim, County of Orange, State of California,as per map recorded in Book 442, page 158 of Deeds in the Office of the County Recorder of Los Angeles County, California. EXCEPT the westerly 234 feet thereof. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on November 22 19 65 notice of which said public hearing was duly given as required by law and the provisionsof.Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation_and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1854 Series 19 65 -66 granting. Variance No. 1743 and WHEREAS, thereafter within twentymtwo:(22).days from the date of the adoption of said resolution, the. City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in grantin said variance and did set a li pubc_.hearing thereon to be he on the 21st day of December, 1965 at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18,_Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that: 1. There is no. substantial property right.,possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission -1 granting Variance No. 1743 be, and the same is hereby dis- approved, and that the petition for a zoning variance permitting a waiver of the one -story height limitation for structures within 150 feet of R -1, One Family Residential zoned property, on the property hereinbefore described, be, and the same is hereby denied.
