1965-864RESOLUTION NO. 65R -864 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 743 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from LAURA M. SCHULZ, 2038 West Lincoln Avenue, Anaheim, California, to permit the establishment of an enclosed restaurant and shopping center, and permitting a waiver of the maximum height limitation of structures within 150 feet of an R -1, One Family Residential Zone, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1. Lot 1 of Tract No. 2299, in the City of Anaheim, County of Orange State of California, as per map recorded in Book 70, pages 44 to 49, inclusive, of Miscellaneous Maps, in the Office of the County Recorder of said County. PARCEL 2. The South 150.24 feet of the North 216.24 feet of the west half of the northwest quarter of the northeast quarter of the northwest quarter of Section 17, Township 4 South, Range 10 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said County. EXCEPT the East 14.00 feet thereof. ALSO EXCEPT the West 120.00 feet thereof. AND public hearing application on said public he provisions of Code; and WHEREAS, the City Planning Commission did hold a at the City Hall in the City of Anaheim upon said October 18 19 65 notices of which aring were duly given as required by law and the Title 18, Chapter 18.76 of the Anaheim Municipal WHEREAS, said Commission, after due inspection, investigation and studies We by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1804 Series 1965 -66 granting Conditional Use Permit No. 743, subject to certain conditions therein set forth and WHEREAS, there_fter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting s:id Conditional Use Permit and did thereupon fix the 23rd day of November 1965 as the time and the Council Chamber in the ity Rall of e City. An,.heim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by l w end the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time nd place fixed for said public hearing, the City Council did duly hold and conduct'such hear- ing and did give all persons interested therein an opportunity. to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful conside- ration of the recommendations of the City Planning Commission and all evidence and reports offered :t said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the re ,a. in which it is proposed to be loc,- ted. 3. The size and shape of the site proposed for the use is adequate to =i llow, the full_development of the proposed use in a manner not detrJfnental to the particular area nor to the peace, he lth, safety and general welfare. 4. The tr ffic generated by the propcsed use will not impose an undue burden upon th .s vets and high ways designed '.nnd improved to carry the traffic in the rea. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and generl welf,re of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- missionranting said Conditional Use Permit be, and the sane is hereby sustained and that Conditional Use Permit No. 743 be, and the same is hereby, granted permitting the establishment of an enclosed restaurant and a shopping center, and permitting a waiver of the maximum height limitation of structures within 150 feet of an R -1, One- Family Residential Zone, on the property hereinbefore described, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 2. That the trash storage area shall be relocated to Parking Stall No. 62. ATTEST: CLE OF CITY OF ANAHEIM 3. That effective screening of a minimum height of ten feet upon planting shall be provided along the south side of subject property, and that said screening shall be subject to the approval of the Superintendent of Parkway Maintenance. 4. That this conditional use permit is granted subject to the completion of Reclassification Proceedings No. 65 -66 -30 now pending. 5. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1, Revision No. 1; provided, however, that all building setbacks along Lincoln Avenue shall be 35 feet, and provided further that the landscaping area abutting the parking areas along Lincoln Avenue and Empire Street shall be a minimum of three feet in width. The City Council hereby reserves the right to revoke such conditional use permit for good cause or failure of said owner, her heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
