1965-847RESOLUTION NO. 65R -847 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 63R-84 IN RECLASSIFICATION PROCEEDINGS NO. 62- 63 -29. WHEREAS, the City Council did heretofore, to wit, on February 5, 1963, adopt Resolution No. 63R -84 in Reclassifica- tion Proceedings No. 62 -63 -29 finding and determining that the property and area therein described should be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE and R -1, ONE FAMILY RESIDENTIAL ZONE to C -1, NEIGHBORHOOD COMMERCIAL ZONE, subject to certain conditions set forth in said resolution; and WHEREAS, Condition No. 4 of Resolution No. 63R -84 reads as follows: "4. That the owners of Lots 96, 97, 98, 100, 101 and 102 shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of said property to business and professional offices only; shall provide that the front yards of said Lots 96, 97, 98, 100, 101 and 102 shall be fully landscaped and maintained as a condition of use, and shall not be blacktopped nor used for parking purposes; that the existing front yard setback on said lots shall not be substantially reduced; that all signs and advertising visible from State College Boulevard and Broadway shall be limited to one free standing, unlighted sign per lot, with a maximum area of 8 square feet, said signs to be of uniform appearance and subject to the approval of the Development Review Committee; and that no flags, banners, lighted signs, billboards or rotating devices shall be established in conjunction with the use of any existing residential structures. Said deed restrictions may be removed upon certifi- cation by the Chief Building Inspector that all existing residential structures have been removed from said lots." AND WHEREAS, since the adoption of Resolution No. 63R -84 the C -1 Zone has been revised and now permits commercial use of residential structures, provided said structures are altered to conform to commercial standards; and WHEREAS, the City Council finds that Condition No. 4 should, therefore, be deleted from said Resolution No. 63R -84 thereby eliminating the necessity for the C -1 deed restrictions on all properties included in Reclassification Proceedings No. 62- 63 -29. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 63R -84 in Reclassification No. 62 -63 -29 be, and the same is hereby amended by deleting therefrom Condition No. 4. 62 -63 -29 BE IT FURTHER RESOLVED that in all other respects, except as amended by Resolution No. 65R -287, said Resolution No. 63R -84 be, and remain in full force and effect.
