RESOLUTION NO. 65R- 828
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A RIGHT OF WAY EASEMENT
OVER THAT CERTAIN ROAD SYSTEM HEREINAFTER
DESCRIBED, FOR THE PURPOSE OF SERVICING CITY
OWNED FACILITIES.
WHEREAS, the City of Anaheim is desirous of purchasing
the hereinafter described real property for an easement for
right of way purposes; and
WHEREAS, ORANGE COUNTY WATER DISTRICT, the owner of
said property, has offered to grant to the City of Anaheim, for
the sum of $10.00 cash, lawful money of the United States, and
subject to the terms, covenants and conditions set forth in
a certain Easement Agreement dated October 20, 1965, this day
tendered to the City, a permanent non- exclusive easement and
right of way to travel over Orange County Water District's
road system, more particularly hereinafter described, together
with the right of entry on lands of said District as may be
necessary and convenient to the use of said easement and
right -of -way; and
WHEREAS, the City Council finds that said offer is
fair and reasonable and that it would be to the advantage and
for the best interest of the City of Anaheim to accept said
grant of easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of ORANGE COUNTY WATER
DISTRICT, a public corporation, to grant to the City of Anaheim,
its successors and assigns, a permanent non exclusive easement
and right of way to travel over Orange County Water District's
road system located on and /or adjacent to the northerly con-
taining Levee of the Santa Ana River between Newkirk Road
extended southerly and Richfield Road extended southerly, for
the purposes of maintaining and repairing any and all facilities
of the City located upon or adjacent to said District -owned
property, together with the right of entry on lands of said
District as may be necessary and convenient to the use of said
right -of -way easement, for the sum of $10.00 cash, lawful money
of the United States, and subject to the terms, covenants, and
conditions set forth in that certain Easement Agreement dated
October 20, 1965, this day tendered to the City Council by
Orange County Water District, be, and the same is hereby, ac-
cepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to accept said Right of Way
Easement for and on behalf of the City of Anaheim.
BE IT FURTHER RESOLVED that the Director of Finance
be, and he is hereby, authorized to pay to said Orange County
Water District the sum of $10.00.
THE FOREGOING RESOLUTION is approved and signed by
