A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF A COOPERATIVE AGREEMENT
WITH THE DEPARTMENT OF PUBLIC WORKS, DIVI-
SION OF HIGHWAYS, WITH REFERENCE TO CON-
STRUCTION WORK ON STATE HIGHWAY 39 (BEACH
BOULEVARD) UNDER ENCROACHMENT PERMIT NO.
765 -E- 763973.
WHEREAS, the Department of Public Works, Division of
Highways, under Division of Highways Encroachment Permit No.
765 -E- 763973, dated September 13, 1965, issued to Wilshire Oil
Company, authorized work on State Highway 39 (Beach Boulevard);
and
WHEREAS, the Department of Public Works Division of
Highways has submitted to the City of Anaheim a Cooperative
Agreement to be entered into between the City and said Depart-
ment of Public Works, Division of Highways, providing that:
1. All or a portion of the work authorized by said
encroachment permit is to be performed in a portion of
said State Highway which is included in the Select System
of the City of Anaheim as established under Streets and
Highways Code Section 186.3.
2. The work authorized to be performed by said en-
croachment permit which constitutes construction or rights
of way within the meaning of Streets and Highways Code
Sections 186.3 and 186.4, shall, to the extent that it
meets the engineering standards established pursuant to
Streets and Highways Code Section 186.8, consist of the
following:
Construct curb and gutter, base, pavement and
drainage structures.
3. The City shall furnish the Division of Highways
with plans of the work specified in Item 2 hereof, prior
to commencement of said work.
4. The City shall advise the Division of Highways
of the completion of said work.
AND WHEREAS, the City Council finds that said agree-
ment is in the best interest of the City and should be approved.
NOW, THEREFORE BE IT RESOLVED by the City Council
of the City of Anaheim that the Cooperative Agreement submitted
to the City by the Department of Public Works, Division of High-
ways, and hereinabove referred to, be and the same is hereby
approved and that the Director of Public Works and Superinten-
dent of Streets be and he is hereby authorized to execute said
agreement for and on behalf of the City of Anaheim.
