A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND THE COUNTY OF ORANGE, WITH REFER-
ENCE TO THE IMPROVEMENT OF KATELLA AVENUE
BETWEEN HOWELL STREET AND THE SANTA ANA RIVER.
WHEREAS, the County of Orange is planning to construct
roadway improvements on Katella Avenue between Howell Street and
the Santa Ana River; and
WHEREAS, the City of Anaheim's overall drainage plan
in the vicinity of the County's project calls for collecting
all of the water entering the intersection of Douglass Street
and Katella Avenue into a storm drain and draining it easterly
into the Santa Ana River; and
WHEREAS, the County's obligation for the drainage at
said intersection is limited to the additional runoff antici-
pated from the Refuse Transfer Station No. III, which is to be
handled by a storm drain running easterly on Katella Avenue and
draining into the Santa Ana River; and
WHEREAS, the City proposes to eliminate two existing
pipe culverts crossing Katella Avenue at Douglass Street and to
drain this water into the County's proposed storm drain, thereby
increasing the size and cost of said storm drain installation;
and
WHEREAS, the City has offered to bear the increased
cost of the larger storm drain system so that the City can main-
tain their overall drainage plan for the area; and
WHEREAS, it is considered of mutual interest and bene-
fit to the parties that the County include the City's proposal in
the County's project; and
WHEREAS, the County of Orange has tendered to the City
of Anaheim a form of agreement to be entered into between the
parties providing for the inclusion of the City's proposal in the
County's project, the terms and conditions of which the City
Council finds to be fair and reasonable.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement tendered to the City of
Anaheim by the County of Orange to be made and entered into
between the parties, providing for the incorporation of the City's
drainage proposal into the County's project, said proposal and
project being more particularly outlined above, upon the terms
and conditions hereinafter set forth, be, and the same is hereby
approved. Said terms and conditions are as follows:
1. That the County shall incorporate the City's drainage
proposal in the plans and specifications for the
project.

2. That the City Shall:
a. Approve the plans and specifications for the
project as it pertains ,to the City portions.
b. Deposit with the County the sum of ten thousand
dollars ($10,000) for City's obligation for the
increased storm drain cost.
3. Said ten thousand dollar ($10,000) deposit by the City
shall be made within thirty (30) days of the date of
said agreement. Said deposit is based on the engineer's
estimate of the increased cost due to the City's pro-
posal and shall be considered final consideration for
the City's obligation for the increased size of the
storm drain installation.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement for
and on behalf of the City of Anaheim.
BE IT FURTHER RESOLVED that the Finance Director be,
and he is hereby, authorized to deposit with the County of Orange
the sum of $10,000.00 as provided in said agreement.
THE FOREGOING RESOLUTION is approved and signed by me
this 26th day of October, 1965.
