1965-782RESOLUTION NO. 65R -782 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINALLY ACCEPTING THE COMPLETION AND THE FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION INCLUDING POWER, FUEL AND WATER, AND THE PERFORMANCE OF ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC IMPROVEMENT, TO WIT: IURNISHING AND INSTALLING A WA TRANSMIS- o (NOHL RAN 8 WORK ORDER NO. 6002. WHEREAS the City Council of the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on the 17th and 24th days of December 1964 a notice inviting sealed proposals for furnishing the flowing: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with awi :s therefor on file in mission main, Unit No. 8, in the County of Orange, along and through the following described property: PARCEL 1: A strip of land, 60.00 feet in width, lying 30.00 feet on each side of the following described line: Beginning at a point South 15 00' 00" East 50.62 feet from Point "AB" described in Parcel 9; thence North 15 00' 00" West 70.62 feet to the beginning of a tangent curve concave Southwesterly having a radius of 600.00 feet; thence Northwesterly and Westerly 1023.64 feet through a central angle of 97' 45' 00 thence South 67' 15' 00" West 122.00 feet to the beginning of a tangent curve concave Northerly having a radius of 600.00 feet; thence Westerly 382.23 feet along said curve through a central angle of 36' 30' 00 thence North 76 15' 00" West 273.50 feet to the beginning of a tangent curve concave southerly having a radius of 600.00 feet; thence Westerly 476.47 feet along said curve through a central angle of 45 30' 00 thence South 58 15' 00" West 424.50 feet to the beginning of a tangent curve concave north- westerly having a radius of 600.00 feet; thence South- westerly 476.47 feet along said curve through a central angle of 45' 30' 00" to the beginning of a reverse curve having a radius of 600.00 feet; thence Westerly 308. 92 feet along said curve through a central angle of 29 30' 00 thence South 74' 15' 00" West 1431.84 feet to the beginning of a tangent curve concave Northerly having a radius of 600.00 feet; thence Westerly 316.78 feet along said curve through a central angle of 30 15' 00 thence North 75 30' 00" West, tangent to said curve, 1108.89 feet to the beginning o a tangent curve concave Northeasterly having a radius of 600.00 feet; thence northwesterly 277.51 feet along said curve through a central angle of 26 30' 00 thence North 49 00''00" West, tangent to said curve, 110.25 feet to the beginning of a tangent curve concave southwest- erly having a radius of 600.00 feet; thence northwesterly 534.77 feet along said curve through a central angle of 51' 04' 00" to tangency with the centerline of the exist- ing Lincoln Avenue. PARCEL 2: A strip of land, 60.00 feet in width, lying J0.00 feet on each side of the following described line: Beginning at Point "AA" described in Parcel thence South 47 15' 00" West 45.50 feet to ning of a tangent curve concave Northwester radius of 600.00 feet; thence Southwesterly along said curve through a central angle of to a point hereinafter referred to as Point 2 above; the begin ly having a 290.60 feet 27' 45' 00" "AB". including line drainage structures, 4 inch combination air and vacuum /air release valve assembly, 18 -inch line valve, 12 and 8 -inch valve assemblies; clearing and grubbing of roadway; conditioning and striping roadway; excavation of m.e.r4 l from rnnd.aav arasa and tranannrt to and eon act in i the City of Anaheim did open said sealed proposals received up to that time for the furnishing of all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work neces- sary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, the public improvement hereinabove more particularly described and set forth, in public, in the City Council Chamber in the City Hall, Anaheim, California, and the City Engineer did tabulate the result of said sealed proposals and did make a re- port to the City Council at its next regular meeting; and WHEREAS, the City Council of the City of Anaheim did, at its next regular meeting, held on the 12th day of January 19 65: at the hour of 1:30 o'clock P.M., con- sider the sealed proposals submitted for furnishing the materials and performing the work hereinabove more particularly described and set forth, and did thereupon find and determine that the sealed proposal submitted by FAMCO CO. 2840 West 1st Street Santa Ana California or t e construct on, nsta ation an comp et on o sa Water Transmission Main Unit No. 8 in th Co unt y of Oran:e Nohl Ranc or ereina�e mentione. ar sescr .e. was t e owest respons e pro- posal submitted therefor, and thereupon accepted said bid and did award a contract to said FAMCO CONSTRUCTION CO. for furnishing all plant, labor, ser- vices, materials and equipment and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings, the said public improvement as specified in said notice inviting sealed proposals, and did authorize the Mayor and the City Clerk of the City of Anaheim to execute a contract for and on behalf of the City of Anaheim with F�A CO CONSTRUCTION CO wh ich said contract wa d ify made and entered into on the 14th day of January 19 65 and WHEREAS, the said FA MCO CO NSTRUCTION CO. as urn s e a pant, a ser- vices, mater s an equ p men t and all utilities and transportation, and performed all work necessary for the construction and completion, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings of said public improvement as specified in the notice inviting sealed proposals and in the de- tailed designs, plans, drawings, and specifications prepared by Bo le En•ineerin: and the contract made an entere• nto w t t .y t o ty o Anaheim; and WHEREAS, the Director of Public Works has duly certified to the construction and completion of said public improve- ment hereinabove mentioned and described, in accordance with the plans and specifications and the contract documents duly made and entered into with said FAMCO CONSTRUCTION CO. WHEREAS, the City Council finds that said contractor has completed said public improvement hereinabove more particularly described in accordance with the provisions of the contract and the contract documents, and that notice of completion should be filed and payment of the balance due said contractor authorized in accordance with the contract documents. an NOW THEREFORE v BE IT RESOLVED by the City Council of the City of Anaheim that all plant, labor,,.;ervices, materials and equipment and all utilities and transportation, and the per- formance of all work necessary to construct, install and com- plete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, together with the appurtenances thereto, said public improvement herein above more particularly described and set forth, by said contractor, be, and the same are hereby accepted, subject, nevertheless, to all the terms, conditions and provisions of the contract documents, and that the balance due said contractor for said work )e pd id to it thirty -five (35) days from and after final acceptance of saork as evidenced by the adoption of this resolution, but not sooner than thirty (30) days after the date of the filing of notice of completion, excepting only such sum or sums as m6Ly lawfully be withheld in accordance with the provisions of said contract and contract documents. That accept- ance by the contractor of said payments made in accordance with said final estimate shall operate and shall be a release to the City of Anaheim, its officers, agents and employees from all claims and liabilities due the contractor for anything done or furnished or withheld or for anything relating to the work or any act or neglect of the City, its officers, agents and employees, excepting only claims against the City for amounts withheld by the City at the time of such payment. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby authorized to execute and file a notice of completion of said work as required by law.
