Slaughter Chairman Seymour called the regular meeting of the Anaheim Redevelopment Agency to order. MINUTES On motion by Mrs. Kaywood, seconded by Mr. Roth, minutes of the Anaheim Redevelopment Agency regular meetings held December 19, 1978 and January 16, 1979, were approved. MOTION CARRIED. FINANCIAL DEMANDS AGAINST THE ANAHEIM REDEVELOPMENT AGENCY in the amount of $528,256.77, in accordance with the 1978 -79 Budget, were approved. 161.158: AWARD OF BID - FIXTURES AND EQUIPMENT. SALE NO. 78 -6: In accordance with recommendations of the Executive Director, Mr. Kott offered Resolution No. ARA79 -8 for adoption, accepting the highest bid for fixtures and equipment sale 78 -6 (beauty shop, bar, miscellaneous retail stores and a complete ceramics shop), on a lot basis as follows: Lot No. 1, McCormick Bentley, Ent., $75.00; Lot Nos. 2 and 12, Robert Josephson, $169.21; Lot No. 3, Penny Naetzel, $300.00; Lot Nos. 4, 6 9 11 and 13, Proppe Antiques, $2,244.10; Lot No. 5, Alan Pash Company, $36.20; Lot No. 7, Jim Ort, $135.00; Lot No. 8, William Fackiner, $225.00; and Lot No. 10, Reliable Carpets, $350.00. ARA79 -8 : A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY ACCEPTING OFFERS TO PURCHASE CERTAIN AGENCY PROPERTY AND AUTHOR- IZING AND DIRECTING THE EXECUTIVE DIRECTOR TO EXECUTE BILLS OF SALE THEREOF. MOTION On motion by Mrs. Kaywood, seconded by Mr. Overholt, the Agency Counsel was directed to prepare necessary documents for the award and sale of fixtures and equipment, to be executed by the Executive Director. MOTION CARRIED. 161.107: AWARD OF BID - DEMOLITION CONTRACT NO. D79 -1: Executive Director Norman J. Priest's recommendation was submitted, recommend- ing that the Agency accept the low bid of $40,000.00 for demolition and site clearance, 301, 309, 323, 325 and 347 West Lincoln Avenue, as submitted by Wilkinson Construction; further, that should the low bidder be unable to furnish required bonding and insurance, that necessary steps be taken to execute an agreement with the next lowest responsible bidder, Hintz Wrecking Co., Inc. Mr. Garald J. Orman, of Launer, Chaffee, Ward & Orman, Attorneys representing the Anaheim Society for Preservation Action, requested permission to address the Redevelopment Agency regarding Agency Block Parcels 2/15, 2/16 and 2/17, the Rosemarie Apartments at 301 to 309 West Lincoln Avenue, and Martenet Hardware at 323 -325 West Lincoln Avenue. He stated that these properties have been recognized by the State Historical Resources Commission and the State Preserva- tion Officer as having historical significance, and have been nominated for Federal Registry in the National Register of Historic Places. He requested that those properties be withheld from the proposed award of demolition contract. Mr. Orman inquired whether the second amendment to the Redevelopment Plan for Redevelopment Project Alpha 1976, and the Draft Subsequent Environmental Impact Report (EIR) dated September 1976, was the plan under which the City is currently operating. Mr. Priest furnished Mr. Orman with a copy of the Redevelopment Plan adopted in 1973, and advised that the document was the 1976 amended version of the 1973 plan, under the California Health and Safety Code. Mr, Orman referred to the Draft Subsequent EIR relating to the Second Amendment to the Redevelopment Plan, Redevelopment Project Alpha, noting references contained therein to preservation of historic places, and he expressed the opinion that this was the time to pre- serve those buildings, pending establishment of their significance, by the Federal Registry. He inquired on what basis these buildings were not being considered for preservation. 79 -11 Anaheim Redevelopment Agency, January 23, 1979, 1:00 P.M. ^` Mr. Priest briefly reviewed the consideration given to the historical significance of the buildings in question, which are located within the projected Lincoln Avenue right -of -way. Responding to further questions by Mr. Orman, he advised that Lincoln Avenue was redesigned in 1977, after the "re- direction" of the Redevelopment program for Project Alpha which took place in late spring or early summer of 1976. Engineers have advised that it would not be feasible to make a devia- tion in Lincoln Avenue in order to preserve the two buildings in question. Relocation of the occupants thereof is in progress and demolition should take place by the end of the first quarter in 1979. Deputy City Attorney Malcolm E. Slaughter advised that the timing depends on the awarding of the contract and the company's execution and return of the necessary documents. Mr. Orman briefed the contents of his letter submitted this date, advising that the position of the group he represented was that the people best qualified to analyze and determine the historic value of buildings in the downtown redevelopment area are those at the State level. He was of the opinion that nothing would be lost by taking some time to allow evaluation. In answer to a question by Mrs. Kaywood, Ms. Diann Marsh, President of the Anaheim Society for Preservation Action, advised that the group had been formed in November of 1978. Mr. Kott questioned the Executive Director's recommendation that the contract be awarded to the second low responsible bidder in the event the low bidder is unable to furnish required bonding and insurance. Mr. Priest explained that on occasion a demolition contractor has problems with bonding; therefore the recommendation to combine the action, as has been done on certain previous Agency actions, was again requested in the interest of time. In reference to points expressed by Mr. Orman, Mr. Seymour pointed out that the State Historical Resources Commission first notified the City of Anaheim in August of 1978 that they would hold a hearing on September 1, thus providing the City with less than one month to properly research the application for historical designation of cer- tain buildings and prepare a response. Minutes of the State Historical Resources Commission meeting indicate that only one member of the Commission had actually viewed the properties named in the applica- tion, and in his opinion this would indicate that either the Commis- sioners were too busy, did not care, or did not consider review of those properties was important. Regarding taking some time for evaluation, this was accomplished in 1976 through a series of public meetings to which the public was invited, at which time the entire Redevelopment project was discussed and debated, and the original 79 -12 Anaheim Redevelopment Agency, January 23, 1979, 1 :00 P.M. 1973 Redevelopment Plan amended in February of 1977. Since that time, the City has been on a course of action having no relationship to the old Disney -type plan, which was abandoned in favor of a plan more sensitive to the people in the Redevelopment project area. The City of Anaheim is appealing the decision of the State Historic Resources `Commission to the Federal Registry. In accordance with the recommendations of the Executive Director, Mr. Seymour thereupon offered Resolution No. ARA79 -9 for adoption. Refer to Resolution Book. RESOLUTION NO. ARA79 -9 : A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR DEMOLITION AND CLEARANCE OF CERTAIN AGENCY PROPERTIES. (D79 -1, Wilkinson Construction) Mr. Kott advised he was somewhat sympathetic to Mr. Orman's request for a delay, and questioned whether a delay would be detrimental to the total Redevelopment project. Mr. Priest pointed out that the City is an a combined schedule of constructing public improvements and of land grants for the W & D Development project for the neighborhood center scheduled to commence construction in the subject area in May. The City is involved in relocation of tenants in the buildings in question, and must complete demolition. Mr. Slaughter recalled that in accordance with authorization by the Redevelopment Agency, actions of unlawful detainer have been filed in the courts against some of the apartment tenants to vacate the property, due to the Agency's early need to complete demolition. The resolution was re- stated.
