Priest CITY ENGINEER: William Devitt Chairman Seymour called the regular meeting of the Anaheim Redevelopment Agency to order at 1:05 p.m. MINUTES On motion by Mr. Bay, seconded by Mrs. Kaywood, minutes of the Anaheim Redevelopment Agency regular meeting held April 7, 1981, were approved. MOTION CARRIED. FINANCIAL DEMANDS AGAINST THE ANAHEIM REDEVELOPMENT AGENCY in the amount of $28,143.88, in accordance with the 1980 -81 Budget, were approved. 161: MONTHLY STATUS REPORT - MARCH 1981: On motion by Mrs. Kaywood seconded by Mr. Overholt, the Monthly Status Report covering Redevelop- ment activities for the month of March 1981, was ordered received and filed. MOTION CARRIED. 161.158: RELOCATION CLAIM - CASE NO. 207 -TB: On motion by Mr. Roth, seconded by Mr. Overholt, payment of a business relocation claim in the amount of $45,254.51 for a total not to exceed $93,000.00, in Case No. 207 -TB, was authorized, as recommended by the Executive Director. MOTION CARRIED. 161.158: RELOCATION CLAIM CASE NO. 260 -TB: On motion by Mr. Overholt, seconded by Mr. Bay, payment of a business relocation claim in an amount not to exceed $29,000.00 in Case No. 260 -TB, was authorized, as recommended by the Executive Director. MOTION CARRIED. 161: BIENNIAL PUBLIC HEARING - REDEVELOPMENT PROJECT ALPHA REDEVELOPMENT PLAN Public Hearing was held to review and evaluate the progress of the Redevelopment Plan for Redevelopment Project Alpha. The Executive Director summarized his report on the progress of the Plan. Chairman Seymour asked if Agency Members had any questions or comments, and hearing none, he asked if any member of the public wished to comment. 81 -34 ANAHEIM REDEVELOPMENT AGENCY, APRIL 21, 1981, 1:00 P.M. Mr, Murray Weisberg, owner of the Angels Carwash on South Anaheim Boule- vard, addressed the Redevelopment Agency stressing the need for vehicular traffic access to the downtown area. He was of the opinion that the new overpass at the Santa Ana Freeway would not accomplish what the merchants originally hoped, as he had just learned there would be no direct north- bound link with Anaheim Boulevard. He felt that a northbound access was the primary consideration for bringing traffic from the freeway into the Center City. City Engineer William Devitt advised that the City Council had more than one alternate to consider when discussions were held with the State Department of Transportation, and the alternate chosen for participation by the City and the State was less expensive than others. The new over- pass will provide direct southbound access to Katella Avenue from Anaheim Boulevard, and northbound traffic will be channeled from Haster Street via'Katella Avenue to Anaheim Boulevard, He noted that the State Depart- ment of Transportation projected that traffic on Anaheim Boulevard would increase by fifteen percent after completion of the overpass. Mr. Seymour noted that he had recently been informed by the Chairman of the Board at E1 Camino Bank that they had experienced a noticeable increase in their business since the first of the year, just after the Town Center opened. Chairman Seymour asked if anyone else wished to address the Redevelopment Agency; there being no response, he declared the public hearing closed. On motion by Mrs. Kaywood, seconded by Mr. Roth, the Biennial Report for the Project Alpha Redevelopment Plan was ordered received and filed. MOTION CARRIED. 161: OLD EL CAMINO BANK BUILDING RESTORATION AND FINANCING Mr. Priest briefly summarized his report recommending that the Redevelopment Agency approve a resolution of intent relating to the Agency's consideration of financial assistance under the Marks Historical Rehabilitation Act of 1976 Revenue Backed Bond Financing Program, for restoration of the old E1 Camino Bank building. Also recommended for approval was an agreement with Wilson, Morton, Assaf & McElligott for Bond Counsel services in connection with the project. In response to questions by Mrs. Kaywood and Mr. Bay, Mr. Priest reported that the proposed developers intended to restore the exterior of the building to its original appearance, and to do considerable work on the interior appointments. He advised that it was possible to present photo- graphs which would illustrate the original appearance of the building. In answer to questions by Mr, Overholt, Mr. Priest advised that the project was expected to take approximately -nine months, the end result would be a first class building, and the Agency would have the opportunity to discuss mm " specific details when plans were submitted for review. 81 -35 ANAHEIM REDEVELOPMENT AGENCY APRIL 21 1981 1. P.M. Mr. Overholt thereupon offered a resolution for adoption, stating the Agency's intent to establish a Marks Historical Rehabilitation Program and to issue rehabilitation notes for certain historic properties in the City of Anaheim. Mr. Bay requested a brief statement describing the Marks Historic Rehab- ilitation Program and its benefits. Mr. Tom Lake of Wilson, Morton, Assaf & McElligott, proposed Bond Counsel for the project, advised that the bonds would be backed by lease payments from the owner to the Redevelopment Agency. He briefly outlined the procedure for issuing the bonds, including two public hearings and the involvement of an advisory commission, due to the historic nature of the project, Mr. Priest indicated that the only alternative for the developers would be to go to conventional financing. Mr. Seymour noted that the action proposed would be to approve the restora- tion and rehabilitation project in spirit, with detailed plans to be considered at a later date. He pointed out that the Agency had previously considered the sale and restoration of the building. Mr. Bay expressed his desire to see how the exterior of the building would appear after such restoration, and he was of the opinion that the structure should be rehabilitated in such a fashion as to be economically feasible. He was not satisfied that historical restoration was the only viable treatment. Agency Members Overholt, Roth and Seymour verbally indicated their support of the proposed historical restoration of the building. It was thereupon moved by Mr. Seymour, seconded by Mr. Overholt, that Agency consideration of the resolution of intent and the proposed agreement for Bond Counsel be continued one week for additional information. MOTION CARRIED, 151.123: EXTENSION TO EXCLUSIVE RIGHT TO NEGOTIATE AGREEMENT - C WILLIAM BRASHEARS Mr. F. K. Friedemann, Attorney representing Dr. C. William Brashears, addressed the Agency advising that a 45 -day extension of time to Exclusive Right to Negotiate Agreement between the Agency and Dr. Brash - ears was being requested to allow finalization of financing arrangements. He advised that the method they had selected was a joint venture of partners and had a financially strong group; the extension would allow completion of necessary paperwork. He expected arrangements to be complete within the 45 -day period, if not before. In the meantime, regular progress reports would be made to the Executive Director, On motion by Mr. Bay, seconded by Mr. Roth, a forty -five day extension to the Exclusive Right to Negotiate Agreement with Dr. C. William Brashears was approved. MOTION CARRIED. 81 -36 ANAHEIM REDEVELOPMENT AGENCY. APRIL 21. 1981. 1:00 P.M. Mr. Priest requested a brief Closed Session to discuss litigation, with action anticipated. RECESS On motion by Mrs. Kaywood, seconded by Mr. Overholt, the Anaheim Redevelopment Agency recessed into Closed Session. MOTION CARRIED. (2:10 P.M.) AFTER RECESS Chairman Seymour reconvened the meeting at 3:00 P.M., all Agency Members being present. 161.121: FINAL ORDER OF CONDEMNATION SUPERIOR COURT CASE NO. 33-83 -69 In accordance with recommendations by the Executive Director and the City Attorney, Mr. Seymour moved that the firm of Oliver, Stoever & Laskin, Special Counsel to the Redevelopment Agency, be authorized to settle con- demnation in Superior Court Case No. 33 -83 -69 in the amount of $210,000.00, plus interest at 7% per annum, plus any accrued costs, and further, to prepare and file the Final Order of Condemnation. Mr. Bay seconded the motion. MOTION CARRIED. ADJOURNMENT There being no further business to come before the Anaheim Redevelopment Agency, Mr. Bay moved to adjourn. Mr. Roth seconded the motion.
