MINUTES On motion by Mr. Thom, seconded by Mr. Roth, the minutes for the regular meeting held August 2, 1977, were approved. MOTION CARRIED. FINANCIAL DEMANDS AGAINST THE ANAHEIM REDEVELOPMENT AGENCY in the amount of 41,230.65, in accordance with the 1977 -78 Budget, were approved. 161.123 SHAPELL GOVERNMENT HOUSING, INC. - FINAL DRAW- INGS Mr. Priest presented and recommended approval of the final construction drawings submitted by Shapell Government Housing, Inc. for the senior citizens project. He noted that there were no sub- """ stantial changes since approval of the preliminary drawings by the Agency on February 1, 1977 and that the final drawings have been reviewed and approved by the City Building Department and the Project Area Committee. With reference to a suggestion offered by the Community Redevelop- ment Commission at the time of approval of the preliminary construc- tion drawings, Mr. Priest reported that the developer had prepared and submitted to HUD a plan for an "S" shaped walkway between the two buildings to which HUD responded that the only connection that would be considered would have to be a direct connection between the buildings. Recognizing the addition of a direct access walkway would require a major redesign of the building structures and site plan, further consideration of the second story walkway was not pursued. 77 -86 ANAHEIM REDEVELOPMENT AGENCY - August 9., 1977 1:00 P.M. Mr. Thom moved that the final construction drawings submitted by Shapell Government Housing, Inc. be approved. Mr. Kott seconded the motion. MOTION CARRIED. 161.123.SHAPELL GOVERNMENT HOUSING, INC. - FIRST IMPLEMENTATION AGREEMENT: Mr. Priest recommended approval of a First Implementa tion Agreement to the Contract for Sale of Land for Private Rede- "�" velopment with Shapell Government Housing, Inc. and execution of said agreement by the Executive Director. He noted that the First Implementation Agreement will modify the development site north of Lincoln Avenue at the alley east -of Emily Street, indicating subject area on a map posted on the Chamber wall. Mr. Kott offered Resolution No. ARA77 -59 for adoption. RESOLUTION NO. ARA77 -59 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY APPROVING A PROPOSED FIRST IMPLEMENTATION AGREEMENT IMPLE- MENTING THE CONTRACT FOR SALE OF LAND FOR PRIVATE REDEVELOPMENT BY AND BETWEEN THE ANAHEIM REDEVELOPMENT AGENCY AND SHAPELL GOVERNMENT HOUSING, INC.; AND AUTHORIZING THE EXECUTION OF SAID FIRST IMPLEMEN- TATION AGREEMENT. Mr. Roth seconded the motion. MOTION CARRIED. 161. BANK OF AMERICA NATIONAL TRUST & SAVINGS ASSOCIATION AGREEMENT - REDEVELOPMENT PROJECT ALPHA TAX ALLOCATION BONDS, SERIES A: Mr. Priest recommended approval of the agreement desig- nating Bank of America National Trust & Savings Association as Fiscal Agent for Redevelopment Project Alpha Tax Allocation Bonds, Series A. pursuant to Resolution No, ARA77 -47 adopted July 12, 1977. Mrs. Kaywood offered Resolution No. ARA77 -61 for adoption. RESOLUTION NO. ARA77 -61 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY APPROVING THE DEMOLITION AND SITE CLEARANCE OF CERTAIN AGENCY PROPERTIES AND AUTHORIZING AND DIRECTING THE SECRETARY OF THE AGENCY TO PUBLISH A NOTICE INVITING SEALED PROPOSALS FOR SAID DEMOLITION AND CLEARANCE. (WORK ORDER 957 -11A) Roll Call Vote: AYES: AGENCY MEMBERS: Kaywood, Seymour, Kott, Roth and Thom NOES: AGENCY MEMBERS: None ABSENT: AGENCY MEMBERS: None The Chairman declared Resolution No. ARA77 -61 duly passed and adopted. 161.121 HEARING - PROPERTY CONDEMNATION WITHIN REDEVELOPMENT PROJECT AREA-(106, 108 AND 110 WEST LINCOLN) Mr. Priest recommended that the Agency find and determine the public interest and necessity for acquiring and authorizing the condemnation of certain real property generally located at 106, 108 and 110 West Lincoln. Subject property is needed for the Village Center Project. He noted that final offer of negotiated settlement has been rejected by the property owner and settlement through negotiation is unlikely. ANAHEIM REDEVELOPMENT AGENCY - August 9, 1977,- 1:00 P.M. Mr. Priest further advised that the property owner had been noti- fied of this hearing. The Chairman asked if the property owner or agent was present and wished to be heard. There being no response, Mr. Thom offered Resolution No. ARA77 -62 for adoption. RESOLUTION NO. ARA77 -62 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY FINDING AND DETERMINING THE PUBLIC INTEREST AND NECESSITY FOR ACQUIRING AND AUTHORIZING THE CONDEMNATION OF CERTAIN REAL PROPERTY WITHIN THE REDEVELOPMENT PROJECT AREA. Mrs. Kaywood seconded the motion. MOTION CARRIED. 161.123 RING: - OF CALIFORNIA, INC-. - LETTER OF CREDIT In accordance with the recommendation of the Executive Director, Mrs. Kaywood moved. to return the $10,000 Letter of Credit, deposited in good faith by King of California, Inc. (Leo Freedman), in connection with the 90 -day Negotiation Agreement for a theatre in the downtown area. Mr. Thom seconded the motion. Mr. Kott voted "No ". MOTION CARRIED.
