A RESOLUTION OF THE ANAHEIM REDEVELOPMENT
AGENCY APPROVING THE TERMS AND CONDITIONS
OF THE MASTER COOPERATION AGREEMENT WITH
THE CITY OF ANAHEIM.
WHEREAS, the City of Anaheim and the Anaheim
Redevelopment Agency have heretofore entered into certain
cooperation agreements (Prior Cooperation Agreements); and
WHEREAS, it is necessary and desirable to consolidate
said Prior Cooperation Agreements into a Master Cooperation
Agreement; and
WHEREAS, a Master Cooperation Agreement has been
prepared, the terms and conditions of which are acceptable to
the Anaheim Redevelopment Agency; and
WHEREAS, the necessary environmental review of the
projects set forth therein was undertaken at the time of the
execution of the Prior Cooperation Agreements; and
WHEREAS, said Master Cooperation Agreement is
intended to consolidate said Prior Cooperation Agreements into
a single contract and to provide for changes in the procedures
by which said projects and payments therefor are implemented;
and
WHEREAS, Section 33445 of the California Health and
Safety Code provides that before the Agency may proceed to pay
the City for the cost of such public improvements the City
must consent to such payment, the Agency and the City must take
certain findings and determinations with respect to the issue
of benefit to the Project and the City must also find and
determine that no other reasonable means of financing such
improvements are available to the community.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim
Redevelopment Agency as follows:
1. It is hereby found and determined that the construction
and installation of public improvements as set forth in the
Agreement is of benefit to the Redevelopment Project Alpha
Project area.
2. The Agreement is hereby approved and the Chairman is
hereby authorized and directed to execute said Agreement on
behalf of the Agency.
THE FOREGOING RESOLUTION is approved and adopted by
the Anaheim Redevelopment Agency this 15th day of May, 1979.
