ARA1979-091RESOLUTION NO. ARA 79- A RESOLUTION OF THE ANAHEIM. REDEVELOPMENT AGENCY ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPON- SIBLE BIDDER FOR SITE CLEARANCE AND GRADING AND CONSTRUCTION OF PERIMETER IMPROVEMENTS ON;CERTAIN AGENCY PROPERTIES. (CONTRACT NO. OF, D79 -16) WHEREAS, the Anaheim Redevelopment Agency did solicit and receive sealed proposals for site clearance and grading Af, and construction of perimeter improvements to, Agency proper- ties, to wit: A parcel of land bounded generally by Harbor Boule- vard, realigned Lincoln Avenue, Helena and Chartres Streets - Parcel Map No. 79 -228, in accordance with the specifications on file in the Office of the Secretary of the Agency; and WHEREAS, the Anaheim Redevelopment Agency did solicit sealed proposals for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, in- cluding power, fuel and water, and performing all work necessary to complete in a good and workmanlike manner, the,site - clearance and grading hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the pro- visions of Section 1770 of the Labor Code, the Anaheim Redevelopment Agency had ascertained the prevailing rate of wages in the locality in which this type of labor is to be per - formed for each craft or type of workman or mechanic needed to execute•the contract, and which wage scale is on file in the Office-of the Secretary of the Agency; and WHEREAS, the Agency representative did receive-the fc llo:iing sealed proposals on the day of August , 19 , in response to the notice aforesaid inviting sealed pro- posals, to wit: -1- o � . ?AME TOTAL PRICE SULLY- MILLER CONSTRUCTION COMPANY'. $33,291.40 MC AFEE & MORISETTE . . . . . . . . . . . . . $39,616.30 SILVERI & RUIZ CONSTRUCTION COMPANY . . . . . $39,783.75 MAC -WELL COMPANY. . . . . . . . . . . $42,818.85 CAL EX PAVING ... . . . . . . . . . . . . . $43,282.00 FELDSEN, INC . . . . . . . . . . . . . . . . . $46 ,333.30 T. CROSBY. . . . . . . . . . . . . . . . $62,706.50 WHEREAS, the Agency representative did thereupon ex- mine and tabulate said sealed proposals and did report to the Anaheim Redevelopment Agency the result of his examination and tabulations; and WHEREAS, the Anaheim Redevelopment Agency finds that the sealed proposal submitted by SULLY - MILLER CONTRACTING COMPANY, Post Office Box 432, Orange, California 92667 is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and. transportation, including powet, fuel and water and performing all work necessary to complete in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Agency, the site clearance and grading hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notice in- viting sealed proposals, and that said proposal of said above - .named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the Anaheim Redevelopment Agency finds that the above- mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or cor- poration and that the proposal submitted is the best suited and fitted for the site clearance and grading-an-ft construction -of peri- meter improvements to be undertaken. NOW, THEREFORE, BE IT RESOLVED by the Anaheim. Redevelopment Agency that the sealed proposal submitted by said contractor for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, in- cluding.power, fuel and water, and performing all work necessary to complete, in a good and workmanlike manner, in strict accord ance with. the specifications therefor on file in the Office of the Secretary of the Anaheim Redevelopment Agency and the notice -2- inviting sealed �,. oposals, the site _clearanc, and wading herein- above more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the completion of said site clearance and grading be, and the same is hereby,. awarded to the said above - named bidder. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set fcrth, shall be, and they are hereby, required to execute a contract in the required form with the Anaheim Redevelopment Agency upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the specifications for said Improvement hereinabove described, and in accordance with the terms, conditions and provisions of this resolution, and said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in the amount of THIRTY -THREE THOUSAND TWO HUNDRED NINETY -OINE AND 40 /100 DOLLARS` for all labor, materials and equipment to be furnished and per- formed, as set forth i.n the sealed proposal submitted by said bidder for the'Improvement, together with the appurtenances thereto or such portion thereof as is covered by said contract, as security for the faithful performance of said contract, and a separate surety bond in the amount of THIRTY -THREE THOUSAND TWO HUNDRED NINETY -ONE AND 40/100 DOLLARS* as security for the payment of all persons performing labor and furnishing material for said Improvement. BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby, required to furnish to the Anaheim Redevelopment Agency in commanies satisfactory to the Anaheim Redevelopment Agency, public liability, property damage, compensation,' and other insurance in the amounts and for the purposes set forth and specified in the notice inviting sealed proposals, and subject to the approval of the General Counsel of the Agency as to form and sufficiency. BE IT FURTHER RESOLVED that the Chairman and Secretary of the Anaheim Redevelopment Agency be, and they are hereby, authorized and-directed make, execute and enter into, for and on behalf of the Anaheim Redevelopment Agency, a written contract with said successful bidder or bidders for the furnishing of all r m plant, labor, materials and equipment and perloring all work, as hereinabove more particularly described for the completion of site,clearanee and grading here= nabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the specifications, and all addenda thereto, and all modifications incorporated therein orior to the date of the open- bids , on file in the Office of the Secretary of the Anaheim ing o� Redevelopment Agency and in strict accordance with the terms, conditions and rrovisions of this resolution, and in accordance with all of the contract documents herein specified. *($33,291. -3- c THE FG:ir;GOING RESOLUTION is appro.ed and adopted by the Anaheim Redevelopment Agency this 4th day of September, 1979..
