ARA1984-040RESOLUTION NO. ARA84 -40 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR DEMOLITION AND SITE CLEARANCE AT VARIOUS LOCATIONS IN THE REDEVELOPMENT AREA. (Contract No. D84 -4) WHEREAS, the Anaheim Redevelopment Agency did solicit and receive sealed proposals for DEMOLITION AND SITE CLEARANCE AT VARIOUS LOCATIONS IN THE REDEVELOPMENT AREA, to wit: Demolition site clearance at various locations in the City of Anaheim listed below (hereinafter "Improvement "), 325 W. Broadway (Church) 220 N. Philadelphia Street 212 -218 N. Philadelphia Street 212 N. Topeka Street 605 & 605 -1/2 E. Chartres Street 114, 114A, 114B & C S. Philadelphia Street 908 & 908 -1/2 E. Lincoln Avenue 912 & 912 -1/2 E. Lincoln Avenue 406 E. Lincoln Avenue 261 -279 E. Old Lincoln Avenue in accordance with the specifications on file in the Office of the Secretary of the Agency; and WHEREAS, the Anaheim Redevelopment Agency did solicit sealed proposals for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to complete in a good and workmanlike manner, the Improvement hereinabove more particularly mentioned and described, and which solicitation did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the Anaheim Redevelopment Agency had ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the Office of the Secretary of the Agency; and WHEREAS, the Agency representative did receive the following sealed proposals on the 6th day of December, 1984, in response to the aforesaid solicitation inviting sealed proposals, to wit: Name Total Price WILLIE GOLDBAR LAND CLEARING AND WRECKING $ 68,755.00 HINTZ WRECKING COMPANY, INC. $ 92,750.00 CHARLIE L. CLARK dba THREE D SERVICE COMPANY $116,434.00 VIKING EQUIPMENT CORP $127,800.00 WHEREAS, the Agency representative did thereupon examine and tabulate said sealed proposals and did report to the Anaheim Redevelopment Agency the result of his examination and tabulations; and WHEREAS, the Anaheim Redevelopment Agency finds that the sealed proposal submitted by WILLIE GOLDBAR LAND CLEARING AND WRECKING is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and performing all work necessary to complete in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Agency, the Improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the solicitation inviting sealed proposals, and that said proposal of said above -named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the Anaheim Redevelopment Agency finds that the above - mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the Improvement to be undertaken. NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelopment Agency that the sealed proposal submitted by said contractor for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to complete, in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Anaheim Redevelopment Agency and the solicitation inviting sealed proposals, the Improvement hereinabove more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the completion of said Improvement be, and the same is hereby, awarded to the said above -named bidder. -2- BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby, required to execute a contract in the required form with the Anaheim Redevelopment Agency upon the terms and conditions specified in the solicitation inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the specifications for said Improvement hereinabove described, and in accordance with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in the amount of SIXTY -EIGHT THOUSAND SEVEN HUNDRED SEVENTY -FIVE for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the Improvement, together with the appurtenances thereto or such portion thereof as is covered by said contract, as security for the faithful performance of said contract, and a separate surety bond in the amount of SIXTY -EIGHT THOUSAND SEVEN HUNDRED SEVENTY -FIVE DOLLARS as security for the payment of all persons performing labor and furnishing material for said Improvement. BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby, required to furnish to the Anaheim Redevelopment Agency in companies satisfactory to the Anaheim Redevelopment Agency, public liability, property damage, workers' compensation, and other insurance in the amounts and for the purposes set forth and specified in the solicitation inviting sealed proposals, and subject to the approval of the General Counsel of the Agency as to form and sufficiency. BE IT FURTHER RESOLVED that the Chairman and Secretary of the Anaheim Redevelopment Agency be, and they are hereby, authorized and directed to make, execute and enter into, for and on behalf of the Anaheim Redevelopment Agency, a written contract with said successful bidder or bidders for the furnishing of all plant, labor, materials and equipment and performing all work, as hereinabove more particularly described for the completion of said Improvement hereinabove described upon the terms and conditions as specified in the solicitation inviting sealed proposals, the specifications, and all addenda thereto, and all modifications incorporated therein prior to the date of the opening of bids, on file in the Office of the Secretary of the Anaheim Redevelopment Agency and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract documents herein specified.
