AHA-1978-005RESOLUTION NO. AHA78- 5 A RESOLUTION OF THE ANAHEIM HOUSING AUTHORITY APPROVING A CONFLICT OF INTEREST CODE FOR THE ANAHEIM HOUSING AUTHORITY AND ADOPTING AND PROMULGATING SAID CONFLICT OF INTEREST CODE. WHEREAS, the Political Reform Act of 1974 (Section 81000 et seq. - Government Code) was approved by the electors of the State of California; and WHEREAS, Section 87300 of said Act requires each agency to promulgate and adopt a Conflict of Interest Code; and WHEREAS, the Anaheim ILLousing Authority did, by Resolution No. AHA76 -2 dated August 31, 1976, adopt a Conflict of Interest Code for the Anaheim Housing Authority and WHEREAS, it is necessary and desirable to amend certain provisions of the Conflict of Interest Code pertain- ing to the place and time of filing statements of financial interest; and WHEREAS, Section 87306 of the Government Code permits amendments to Conflict of Interest Codes; and WHEREAS, a document entitled "Conflict of Interest Code of the Anaheim Housing Authority" ( "Code ") (consist- ing of five pages and Exhibits " A " and "B") attached hereto and incorporated by reference herein, which Code contains the Conflict of Interest Code of the Anaheim Housing Authority, in its entirety, as amended, has been prepared and submitted to the Anaheim Housing Authority, for its consideration; and WHEREAS, said Code is hereby determined to meet the requirements of Section 87300 et seq. of the Government Code. WHEREAS, the staff of the Fair Political Practices Commission has determined and advised that the City Council of the City of Anaheim is the Code reviewing body for the Conflict of Interest Code of the Anaheim Housing Authority, pursuant to Section 82011 of the Government Code. NOW, THEREFORE, BE IT RESOLVED that the Anaheim Housing Authority does hereby adopt and promulgate the "Conflict of Interest Code of the Anaheim Housing Authority," attached hereto and incorporated by reference herein. -1- BE IT FURTHER RESOLVED that the Secretary be, and she is hereby, authorized and directed to transmit a certified copy of this resolution, including said Conflict of Interest Code of the Anaheim Housing Authority adopted thereby, to the City Council of the City of Anaheim for approval. PURPOSE Pursuant to the provisions of Government Code Sections 87300 et seq., the ANAHEIM HOUSING AUTHORITY hereby adopts the following Conflict of Interest Code. Nothing contained herein is intended to modify or abridge the provisions of the Political Reform Act of 1974 (Government Code Section 81000). Tile provisions of this Code are additional to Government Code Section 37100 and other laws pertaining to conflicts of interest. Except as otherwise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein and this Code shall be interpreted in a manner consistent therewith. II. DESIGIVATED POSITIONS The positions listed on Exhibit " A " are designated positions. Authority members and officers holding those positions are deemed to make, or participate in the making of, decisions which may foreseeably have a material effect on a financial interest. III. DISCLOSURE STATEMENTS Designated positions shall be assigned to one or more of the disclosure categories set forth on Exhibit "B." Each Authority member and officer shall file an annual statement disclosing that his or her interest in investments, real property and income designated as reportable under the category to which that position is assigned on Exhibit "B." IV. PLACE AND TIME OF FILING (a) All Authority members and officers required to submit a statement of financial interests shall file the -1- original with the City Clerk of the City of Anaheim (the City Clerk serves as the Secretary of the Anaheim Housing Authority). (b) Authority members and officers appointed to designated positions shall file initial statements within 30 days after date appointed. (c) Annual statements shall be filed no later than April lst of each year by all Authority members and officers. Such statements shall cover the period of the preceding calendar year. (d) Authority members and officers required to file a statement of financial interest with any other agency, which is within the same territorial jurisdiction, may comply with the provisions of this Code by filing a duplicate copy of the statement filed with the other agency, in lieu of an entirely separate document. V. CONTENTS OF DISCLOSURE STATEMENTS Disclosure statements shall be made on forms supplied by the City Clerk of the City of Anaheim and shall contain the following information: (a) Contents of Investment and Real Property Reports: When an investment, or an interest in real property, is required to be reported, the statement shall contain: (1) A statement of the nature of the investment or interest; ME (2) The name of the business entity in which each investment is held, and a general description of the business activity in which the business entity is engaged; (3) The address or other precise location of the real property; (4) A statement whether the fair market value of the investment, or interest in real property, exceeds ten thousand dollars ($10,000), and whether it exceeds one hundred thousand dollars ($100,000). This information need not be provided with respect to an interest in real property which is used principally as the residence of the filer. (b) Contents of Personal Income Reports: When personal income is required to be reported, the statement shall contain: (1) The name and address of each source of income aggregating two hundred and fifty dollars ($250) or more in value, or twenty -five dollars ($25) or more in value if the income was a gift, and a general description of the business activity, if any, of each source; (2) A statement whether the aggregate value of income from each source was greater than one thousand dollars ($1 and whether it was greater than ten thousand dollars ($10,000); -3- (3) A description of the consideration, if any, for which the income was received; (4) In the case of a gift, the amount and the date on which the gift was received. (c) Contents of Business Entity Income Reports: When income of a business entity, including income of a sole proprietorship, is required to be reported, the statement shall contain: (1) The name, address, and a general description of the business activity of the business entity; (2) In the case of a business entity which provides legal or brokerage services, the name of every person who paid fees to the business entity if the filer's pro rata share of fees from such person was equal to or greater than one thousand dollars ($1,000); (3) In the case of a business entity not covered by paragraph (2), the name of every person from whom the business entity received payments if the filer's pro rata share of gross receipts from such person was equa to or greater than ten thousand dollars ($10,000) durinC, a calendar year. (d) Contents of Management Positions Reports: When management positions are required to be reported, Authority members and officers shall list the name of each business entity not specified above in which he is a director, officer, partner, trustee, employee, or in which he holds any position of management. -4- (e) Initial Statement: The initial statement filed by an Authority member or officer appointed to a designated position shall disclose any reportable investments and interests in real property. (f) Acquisition or Disposal During Reporting Period: If the investment, or interest in real property, was partially or wholly acquired or disposed of during the period covered by the statement, the date of acquisition or disposal. VI. DISQUALIFICATION Authority members and officers must disqualify themselves from making or participating in the making of any decisions in which they have a reportable financial interest, when it is reasonably foreseeable that such interest may be materially affected by the decision. No Authority member or officer shall be required to disqualify himself or herself with respect to any matter which could not be legally acted upon or decided without his or her participation. It includes interests held by the designated employee, his spouse, or by a business entity owned by the employee or his spouse. Category II Category II relates to investments with a value of more than $1,000 in business entities having real property in the City of Anaheim or doing or planning to do business in the City of Anaheim. It includes investments held by the designated er;plovee, his spouse or by a business entity owned by the employee or his spouse. Category III Category III relates to sources of income aggregating $250 or more or of gilts aggregating $25 or more if the source is (generally) located within or doing business within the City of Anaheim. It includes sources of income to the designated employee, his spouse or a business entity and by the employee or his spouse. Category IV Category IV relates to investments in and income from financial institutions.
