RESOLUTION OF THE ANAHEIM HOUSING AUTHORITY (I) AUTHORIZING
THE SUBMITTAL OF AN APPLICATION TO THE UNITED STATES
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR FUNDING
UNDER THE HOUSING COUNSELING PROGRAM, (II) IF SELECTED FOR
SUCH FUNDING, AUTHORIZING THE EXECUTION OF DOCUMENTS
NECESSARY TO PARTICIPATE IN THE HOUSING COUNSELING PROGRAM,
AND (III) IF SELECTED FOR SUCH FUNDING, AMENDING THE BUDGET FOR
FISCAL YEAR 2008-09 ACCORDINGLY
WHEREAS, the United States Department of Housing and Urban Development ("HUD")
has issued a Notice of Funding Availability ("NOFA") for the Housing Counseling Program
authorized by Section 106 of the Housing and Urban Development Act of 1968 (12 U.S.C. 1701)
(the "Act"); and
WHEREAS, pursuant to the Act and the regulations for HUD's Housing Counseling
Program (24 CFR part 214) (the "Regulations"), HUD is authorized to approve funding allocations
utilizing monies made available to the Housing Counseling Program, subject to the terms and
conditions of the Act and the Regulations; and
WHEREAS, funding made available under the NOFA ("Housing Counseling Program
Funding") could be used to provide, among other things, comprehensive housing counseling services
to eligible homebuyers, homeowners, renters and homeless persons; and
WHEREAS, the Anaheim Housing Authority (the "Authority") desires to submit an
application to HUD for One Hundred Thousand Dollars ($100,000) of Housing Counseling Program
Funding (the "Application").
NOW, THEREFORE, THE GOVERNING BOARD OF THE ANAHEIM HOUSING
AUTHORITY DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. Approval of Application. The Application is hereby approved.
Section 2. Authorization to Submit Application. The Executive Director, or her
designee, is hereby authorized and directed to execute and submit the Application to HUD.
Section 3. Authorization to Execute Program Documents. The Executive Director,
or her designee, is hereby authorized and directed, if the Authority is selected by HUD to receive
Housing Counseling Program Funding, to take such other actions as are consistent with the
Application, including the execution of all documents required by HUD for participation in the
Housing Counseling Program.
Section 4. Authorization to Use Program Funding. The Executive Director, or her
designee, is hereby authorized and directed, if the Authority is selected by HUD to receive Housing
Counseling Program Funding, to use such finding for eligible activities in the manner presented in
the Application as approved by HUD and in accordance with the Act and the Regulations.
Section 5. Amendment of Budget. Contingent upon the award and receipt of Housing
Counseling Program Funding, the annual budget of the Authority shall be amended by increasing
the appropriations and authorized expenditures in the amount equal to the amount of the Housing
Counseling Program Funding received by the Authority.
THE FOREGOING RESOLUTION IS PASSED, APPROVED AND ADOPTED BY
THE GOVERNING BOARD OF THE ANAHEIM HOUSING AUTHORITY THIS FIFTH
(ST") DAY OF AUGUST, 2008 BY THE FOLLOWING ROLL CALL VOTE:
